  1. Your two statements contradict each other. If you agree that when a judge upholds a law it does not necessarily mean they agree with it, why then must we look to outside their court opinions? Lawyers OFTEN defend those they do not like or agree with. If that were untrue, the public defender would not even exist. In the same token, a good judge will make decisions based on precedence and the law, not their personal views, no matter what those views are. Is it possible to have the judicial view colored by the personal? Sure. But I do not think that is so in this case. Like Rebirth said (see Rebirth, credit), abortion is NOT in the constitution. Well, if you also feel you have no bitch coming when you are arrested and tried for assault and battery ...and receive no more consideration in sentencing than any other individual who was unable to control his aggression and attack a cititizen who was breaking no laws and no direct threat to you or others. If you agree with that, then I have no problem with your position. Well good. Cause that is what I think. Like rehmwa said, the 1st (and actually, the whole bill of rights) protects from the government, not another citizen. If I hit the guy, I would assume I would be arrested. I am not saying I would actually hit anyone. What I am saying is that a fight between two people over what one says is not a 1st issue. They certainly have the right to stand across the street and spout their crap, but if they happened onto the funeral home (and thereby private property), their right to free speech ends as far as I am concerned. It should also be noted that I do not know if they were on the property and I am too lazy to look. In anycase, we are in agreement.
  9. Did you read the article that I posted? It goes to this very question. As does the quote I pulled from that article which you replied to. The bottom line from the article: Just because Alito voted to uphold a law does not mean he has to agree with it. He may or he may not. His dissent is devoid of emotional opinion. And just because it was overturned means nothing. There are probably very few judges around who have never had a decision overturned at one point. The bigger point is that he made the decision he thought was correct UNDER THE LAW...and he did it by using the existing decision from Roe vs Wade. Later, SC overturned that, but no one bats 1000.   10. I see your point, but that just leads us back to the question of why FOX news is popular. I think part of the answer to that question is because they are more accurate. Obviously, you don't. No, its because they are flashier. Flashier, slicker, and quicker will win in todays world. As for this popularity thing, you followed comments about O' Reilly's popularity with statements of how he is number one and so is Fox as some sort of argument for how accurate they are (and you can deny it all you want, but it is what you said). Which I followed with the statement, "if something is popular, it does not mean it is correct." Do you actually believe that something can only become popular because it is correct and BETTER than other things? No wait, you do; that is what the post I am replying to says. If O' Reilly was not slamming his guests or claiming "No Spin" over everyone but himself in a loud and angry voice, do you think he would be number one? Doubtful. His viewers (and most of the viewers of today's OTHER pundit shows) like flashy attitude and angry talking points. It has very little to do with validity nd everything to do with style. Some truth certainly does keep it from dying, but without the flash, The factor would have died years ago. In other areas, I actually do like watching Brit Hume.   13. Wow, that is a silly statement. Millions of people also buy Brittney Spears and Backstreet Boys albums. And I would not even begin to call them "good" music. Popularity is not necessarily a function of quality. Remember Jerry Springer? All of Fox's viewership numbers means is that people today prefer their news more stylized and opinionated; they want MTV "news". News that they can be scared about. ANd it is not just Fox that does it. CNN has gotten into the scare method as well. Fox just does it better. News for the 24 hour networks is all about ratings. Hell, O' Reilly himself kept spouting how SIX MILLION people watch the Factor. Too bad he pulls about a 2.2 share instead. I guess math is not his strong suit. To busy boycotting France. And please note, that I am not defending CBS or the NYT, but to say that just because something is number one means it is correct is pattenly absurd. And just so you know, I HAVE watched the Factor.
