You've figured us out Kallend. We (the police) are really just out to arrest people because it is fun. Who cares about the Constitution anyway. It's all in the interpretation. I especially like the part of the arrest where I get to pull my gun out and yell "get on the ground you maggot!". Gets me all giddy inside. I usually get my buddies to take pictures of me in my firing stance while making the arrest. Makes for nice portraits around the house especially when my jackboots are all shined up and pretty. The police can't arrest someone for that. They can issue a material witness subpoena for someone who has information about a crime where they have to come and testify to a Grand Jury. If they don't show up for the Grand Jury then they can be arrested. The police are arresting these people based on evidence that they are involved in a crime. A judge or Grand Jury has determined that the evidence available proves there is "probable cause" to believe they have committed a crime and issued an arrest warrant. The problem is that you have to prove that they committed the crime "beyond a reasonable doubt" at trial. The police may not have that level of evidence yet and didn't want to arrest them at this time. The Code Orange forced their hand. Now they will be in a race against time to gather enough evidence to convict them before they go to trial. If they are not convicted or the police fail to gather the evidence in time I'm sure everyone will just claim they were picking on these guys. Seems to be a developing trend these days. Most of these guys are probably people they have open cases on that have been going since 2001. The threat situation just forced them to make the arrests earlier than they probably would have liked. It's a situation of "either we arrest them now and risk losing the case in court or we leave them on the street and risk them conducting a terrorist act".
