Generally speaking, yes... to many skydivers it means nothing, and is just decoration... and even to many that read it and understand what it represents, it does not pardon gross neglignece... which is what this suit asserted, and was not contradicted by the defendant. I'm assuming you can PROVE this was gross negligence since you are so quick to find them guilty WITHOUT hearing their side and reading all the posts, especially the one where it stated Rubio knew, and jumped with a worn out pilot chute. I can't believe you won't take the warning label seriously and you think its okay for people to think its just decoration. When did I say I wanted to represent Precision? Saying Precision does not have any morals is an attack but since you said it about a company, they may let it slide. You seem a little worried about the "list". Like I said before, I don't and won't ever own a gear store, gear company, or dz. The Bent Prop in Eloy had a wall of shame at one time, for the people who lacked morals and were a disgrace skydiving. What are ALL the lawsuits you are referring to? It will open the floodgates (as stated on page 1) for more unfounded lawsuits. Go ahead Andy sue away, make friends and influence people. If you all are looking for safety guarantee's then take up bowling. The only guarantee in skydiving is that you will land. But my point is it should have NEVER been brought to court to begin with. Does the warning label on the parachute mean nothing to people? Do you think its just decoration? This lawsuit is the beginning of the end of skydiving. As I see it, and since people are so sue happy, we won't be able to buy a pull up cord in a few years. Not showing up at all seems the singularly most foolish option available, which is I think the point a lot of us have been trying to make. _Am I thought the point most of you were trying to make was sue and you can make lots and lots of money regardless of how stupid the lawsuit is. are you sponsored in full or in part by precision? First off, why would it matter? and NO, I don't get jack shit from Precision - yes, we are in the same state but I live on one side and they are way on the other. I do like some of their products. If PD or any other manufacturer was in this spot, I would feel the same way.The only thing that would change about my posts would be to delete the parts where I said I own and use their canopies. I do not currently own or fly a PD canopy. I used to have a Sabre. I believe a greenie posted something about a worn out PC and damage on the Reserve. dbattman - the reserve had damage to it. His PC was worn out and this guy isn't dead. Who are the 4 people that died because of this? If one person died and was jumping a reserve it the specs of what it was intended, I'm sure a service bulletin would have gone out immediately. I have the -M and have had no problems. Okay, What are the facts? A skydiving manufacturer has NOTHING to gain by knowingly putting out a defective product. I don't understand how people can skydive and think that their gear is perfect and will never malfunction. Skydiving is not a "safe" sport. This perhaps is the only reason that stands out as a reason to no-show at the trial... They knew about the defect, and did nothing... no criminal charges have been filed... go to court to defend yourself, and facts come out during testimony, and are now public record, that you did know... The DA now files charges, and you end up in jail... Not saying that happened here... but it is only scenario that I have sceen here that would justify a no-show. J So you believe, because this rubio guys says so, that Precision purposely put out a defective product? That's bizarre. Especially since their own staff jumps their products. WOW. Okay, if they are negligent, meaning they put out a product they knew could kill or seriously hurt someone, IMO is criminal. They should be thrown in jail. I don't believe Precision would purposely put out a bad product, their own staff jumps their chutes. Otherwise shit happens, and people are not dealing with it anymore. They want that quick fix called MONEY. If you don't want to deal the risks life throws at you, don't leave your bed. Everytime someone sues and companies have to pay, they have less money for R&D. Take that women in MO whose son and husband were killed while the son was flying. She is suing Cessna. I believe Cessna settled only because that can't afford the big fight and now all that money they dished out, even thought they were not negligent, is less money that will go to developing better products. No, I'm not. They didn't have the money to defend themselves and, IMO, this lawsuit is lame, has no merits. By the sounds of this jury, it probably wouldn't have mattered if they showed up or not. Alot of juries will look at Precision as the large evil corporation (which I don't believe be true) and only in it for the money. I fly their canopies have 2 of their reserves with no problems, but then again, I accept the fact that skydiving is extremely high risk and that all my equipment is man made and shit happens that cannot be foreseen. Again, the amount of skydivers wanting/willing to sue is scary as hell. If I ran a gear store, or was a skydiving manufacter or DZO, I would start a list of all the skydivers who think its RIGHT to sue, and deny them any and all service. Luckily for all you who want to sue, I don't and won't. Judy Be kinder than necessary because everyone you meet is fighting some kind of battle. -
But if someone can be found guilty of gross neglegence, isn't that criminal and shouldn't manslaughter or attempted murder or murder charges be filed? Saying the company knows they sold you a product that WILL kill or injury you is saying they tried to murder you. IMO. In this country people sue for every thing. Because this guy is suing because he said they knew something was wrong, he should have filed criminal charges instead of a civil suit, but here in the USA its all about the money. That's great you will pay for the extra testing. Now we could go and sue you because you only paid to have it tested 100 times and on that 101st jump something happened that NO ONE would have even thought to happen. The equipment we use skydiving is tested. You can test it a millon times and it may never malfunction until a million and 1, then what. Lawsuits in skydiving will NEVER be beneficial to our sport. All it does is over regulate it and make equipment so expensive most people will have to quit. Judy Be kinder than necessary because everyone you meet is fighting some kind of battle. -

I ordered mine a month or so ago. I was told on the front end it would take 28 weeks. I have not problem waiting for that rig that long. Yeah it would be nice to have it sooner I was told on the front end how long it will take so I'm not about to start bitching (at least not yet). Stupid? I don't think so. This isn't a guy suing becuase he couldn't pronouce "Xaos." This is a guy who was seriously injured using a product manufactured by PA, and that type of injury should be taked VERY seriously. I KNOW I CAN GET HURT OR KILLED SKYDIVING. I KNOW AND ACCEPT THE FACT THAT ALL MY EQUIPMENT IS MAN MADE AND COULD MALFUNCTION. the lawsuit is stupid and is a waste of the courts time. As I said in another post, the amount of you out there so willing to sue over skydiving is terrifying to me. I really thought all skydivers were different and didn't have that "sue sue sue" mentality. I was very wrong. I have to disagree with you completely. I don't think any skydiving manufactuer has that much money to defend over stupid lawsuits. My stupid xsister-in-law didn't show up to court on a restraining order she filed, so the court just rescheduled. The judgement might as well be for a $100,000,000,000,000,000.
