But yes, most of the testimony was thrown out in this case, and there is now the possibility that he will be released in 10 years on good behavior, provided that his current 1 charge that he was convicted of doesn't get over turned in appeals.   9. Easy, the U.N. doesn't have a vetting process for any of it's members. Sri Lanka put him up and the rest of the world excepted him. Now this man could lead a U.N. coalition into another country. You don't have a problem with that? The examples you gave of Canadian soldiers are of them acting on there own accord. What happens when they are ordered to commit those acts? Do you charge them for refusing to follow orders or do you charge them for war crimes? The diffrence between you and me is that I would never put any soldier in a position where he has to choose his charge. The U.N. has a long history of being a corrupt organization with no real power. Counties all over have ignored there sanctions. As a place for countries to come together in the court of public opinion, it is still useful. Beyond that, it has long outlived it's purpose.   10. You have a lot of your own answers right in your own post. Yes a military tribunal is an actual court that must fall in the constraints of the constitution. A man that goes through a military tribunal gets all the due process of someone tried in a civilian court. The man being tried is not a "civilian" though. He has taken up arms against the U.S. Even worse, he is not uniformed, backed by an official country, and targets civilians. He should be charged with serious war crimes under the Geneva convention to boot. He was not captured by U.S. law enforcement personnel. For a man to be properly convicted in a U.S. court, he really needs to be caught by U.S. law enforcement. This way he is getting all the pre-requisites required by the U.S. court system. Miranda rights, limited incarceration, speedy trial, etc... This man was caught by the Pakistani Police and turned over to the CIA through the state department. None of these people probably Mirandized him. It's not what they do. A military tribunal is still a trial. He still gets a jury, a judge, a lawyer, and due process. The only difference is it's more conducive to how he was captured. I believe in this case, it would be more just and he would actually be held accountable for his crimes.
