Well Proffesor, I am no one to interpret it. Like I said to the other person, It was an opinion. But I will reiterate my point once again. It is not up to the court to CREATE law. IMHO there should be constitutional change in the term of Judges. I have contacted my senators about this. To think a judge can stay in office for life unless they violate law is absurd. Maybe we should be allowed to recall them as well. Although, this would cause other problems I agree, but if we get a few bad apples in there trying to make a name for themselves what can you or I do about it? That isn't very democratic is it? Well, my agument about that is this... I am agnostic. I am a scientist who believes in Darwinism and not some creation theory. However, I understand why there is religion and agree people have the right to practice religion. We need to face the fact that this country was founded on a judeo-christian philosophy ... Like it or not it was! Separation of Church and state was designed more to keep the Government away from religion than it was to keep religion away from the government. Other constituional rights exist such as freedom of speech or expression, and this is where the secularist drive me NUTS. Based on the first ammendment if the State house want to put up a CHRISMAS TREE on the lawn it can, BUT, it can not discriminate and dissallow other religions to put up symbols of celebration for their holidays. But the secularists will tell you NO, the 1st ammendments says No ONE has the right to put anything up. That is a misinterpretation of our constitutuion. You are then preventing expreesion rights. Never thought I would say this: I agree with you Kev 100% .. WOW that was tough to get out. But, this is a societal problem. School programs won't get us there. A new way of thinking on the part of our teachers may. BTW- When I have kids...they are going to private school. Well, while we are being hohnest, i didn't read the final brief of the overruling nor do I know Teax's constitution, but I think Scalia is on to something. The point which he was making ins that the constitution is up for interpretation, and naturally that changes with time, however, A judges job is to be impartial, and free from social pressure in the decisions it makes. It is a body designed not to rule through politiacl belief or personal ideology, instead looking at the arguments in a rational way and comparing them to the written law. Lately in this country this isn't happening there are many cases of it whether it is the pledge, or the 10 commandments (here comes the flame). I agree with you, we should train them to want to succeed, but.. with the way things are now it isn't going to happen. We have elementary school sports where they aren't even allowed to keep score. Why? Because we don't want to hurt anyones feelings... Ohhh isn't that sweet. No - It is building a generation of softies who don't know what winning and loosing is about. So, when they get older they don't know how to deal with defeat, and have no drive to win. I think we should go back to when teachers could actually punish student for their actions. Put a little fear in their life. Push them to succeed. Drive some freakin disipline into them. Well not to argur for the sake of argument, but... If what you do with your body behind closed doors in anyway effects others (through physical or emotional harm) then it is the business of society. Do I feel that this is the case in this situation?No, but the argument could be made in other situations. Example: I shoot heroine in my bedroom and don't leave the house when I am high...so, I should have the right to do that. Wrong because in order for you to get the heroine, you must go through some dealer, and that dealer has murdered or stolen or broken other laws to get the drugs to you. I agree stick to the constitution. Now, you brought up slavery, and what was done about it? An amendment to the constitution was created. At one time women couldn't vote. SO, we amended the constitution. Do you see a patern. Judges don't change laws...that is not there job. However, groups like the ACLU are currently trying to do just that. Change laws through the courts and not through the house and senate. Why? Because they know they can't. So, instead they seek out juritictions where the judges have the same ideology as them and they sue. The ACLU is a scary and hypocrital group with a lot of power. I happen to agree with the Judge. Too many people are trying to change this country toward what they think it should be and not what it is. If a person does not believe in the constitution which was written for this country they have 2 options 1. MOVE 2. Work to get an amendment to it. The court is not in place to make Laws. The City of LA is $200 million in the red. So, the politicains decided they needed to cut some spending. That is understandable and I applaud them for it. So, what do they do? They cut $36million in road and sidewalk repair.... OK - not what I would have cut but hey you had to cut it from somewhere. So what is the big Deal???? The city of LA just approved the building of a retirement home for Gays, Lesbians, and trans gendered people of the age of 65. It will cost the LA taxpayers $18million. First of all, is that unconstitutional? Can you use tax money for public housing but discrimate toward the sexual preference of the people living there???? Secondly, Why can't Gays and transgenders live with the rest of the retired population. Third, why the Fuck is the City spending 18Million on this place when they are trying to cut spending???? Ok, so I am back in the debate after a long night sleep and I am trying to catch up. I think a couple good points were made, however, I think some people don't really see what is going on. Head sart Programs: _ Com'on are you serious? American schools have been Dumbed down soo much it is stupid (pun!!!). Entitlesments are the problem in this society. Everyone thinks they are entitled to something. A back up plan for when they fail. That is called SOCIALISM. America was founded as a republic, a capitalistic society. Do you know what that means???? It is like Darwinism: Survival of the fittest. America is a place of opportunity, however, if you choose to squander that opportunity, you starve and you die. So, make good choices, work hard and you too can live the dream. The thing is the government is not resposible for your bad decisions. It kills me that we have these social programs, IMO these programs cause laziness. People realize that they don't have to try or workhard, because Uncle Sam will support them if they fail. That is crap... If that is what you want fine, move to Canada or Western Europe. The idea of what America should be was much different that what it is. Our found Fathers must be rolling in their graves seeing where this country is going. We left Europe to get away from what is begining to happen here in the US. It is a sad state of affairs.... Bill, I knew you were going to bring up Jewish reparations. But, there is a distinct difference, there are victims directly connected to the Halocaust which are still living. Going back further say...150 years. Jews were still oppressed. No, they weren't murdered by the millions, but if anything the JEWISH past has helped to make the Jew stronger and more resiliant. Minorities though are typically immigrants correct? No, not genetic. Like i said in my first post it is a societal problem. As the saying goes... give someone too much rope and they'll fuck it up. I would like to see an explaiation (intelligent) of how Slavery in the mid 1800's caused the social problems of blacks today. See, this is new. Blacks in the USA 30yrs ago didn't have these problems. Yes, 50 years ago in this country they were oppressed and there was a great deal of racism, however, the same societal problems weren't there. What I am saying is that there is no connection to slavery and the current situation that blacks in america are in. (BTW - I am painting a broad brush there are exceptions obviously.) Well Bill, for the most part the MAJORITY of black americans do consider themselfs as a group. And in many cases like the free handouts they have recieved for being a minority. However, the stats don't lie. The stats are given for Whites, blacks, hispanics, and asians. The numbers for blacks are through the roof. You often here from the "Black Community" excuses on why it is soooo tough for them. Why Slavery 150yrs ago and oppression 50 years ago has profoundly hurt them. I don't hear about JEWS in Germany complaining of the same problem The jews have been persecuted all over the world for a LOT longer than blacks, yet, they seem to be doing fine. In fact, I would go so far as to say they are prospering... To say blacks in america are where they are today because of slavery is BS. Blacks in America are where they are because of Who they are. It may sound harsh, but it is true. 2000 census - 70% of Black children born in the USA to a mother between the ages of 18 and 24 are without a father So, are you going to argue that Slavery is the cause for Black men to be knocking up Black women in this country? No, the reason is no Civic Responsibility. And you know what. When the woman has to work all day to support her kid, who is going to look after the kid?????
