Not sure if they should be termed graded crimes or simply just different crimes. A crime has two elements - actus reus (act) and mens rea (intent). If you change either elemet you get a different crime. I guess this is the justification behind having seperate race hate crimes - you're not just intending to harm someone, you intend to harm them beacuse they are X. Different mens rea, different crime.

I think because of the need for certainty - the award for millionth post needs to go to Roadrash. We simply will not be able to tell who was the millionth post of those not deleted and as I said - that name will change if any more dissapear. Vote Roadrash - I like the idea of someone "winning" who wasn't even trying to.

just that when I asked above how will we know who the millionth poster is - cpoxon posted a link to the milionth post. We've already had it. I guess the post counter shows lower than a milion as it doesnt count the posts that have been deleted. If reply to this post you will see the URL at the top ends with "_post_id=1005115" (in the case of this post) Thats over 5 thousand after the milionth. I guess over 5 thousand posts have been deleted and thus don't count towards the listed total. We can still have another millionth - but we won't be able to tell who it is, and their identity will change depending on whether or not any previous posts are deleted.

I can't bold a camera to my cypres... (but seriously) I have absolutly no misconseption about my helmet saving my life. I do not wear it to save my life but to stop me banging my head and making it hurt. If I'm hit hard I'm gonna be injured and no helmet is going to make much of a difference - its just another one of those risks I accept when I walk out to the plane.

Just look at the last report on here of a cypres fire - it was in England and the guy was wearing a full face helmet. Didn't stop him from waking up on his face in a field with his reserve blowing round him. -
Yeah I can imagine it happening to me. I'm not sure how I feel about that. Remember this is about the legality of the use of force in the defence of the person/home not the legality of guns. You yanks always seem to confuse the two issues. The outcome conviction wise for this guy would have been the same whether he used a gun, a sword, or a brick. Anyway, laters - its midnight here and I gotta be in the corroners court tomorrow morning about 100 miles away cos some dum schmuck swerved in front of my client.

thats it - if you intend to use it, its an offensive weapon and illegal. As John rightly points out it can be very difficult to juge intent... but its not impossible. yup - (except many kinds of knife are illegal because it has been decided they are "made... for use for causing injury") I know its not a particularly good law - I think it sucks and is damn hard to apply. but it does catch trouble makers... albeit at the expense of law abiding citizens... its a ballancing act. Has it swung too far... maybe yeah - the police now have something they can charge people with though. How would you legislate against a pool cue or a sock with a bar of soap in it? Its not as easy as you may think. Yeah, I'm dislexic - sue me.
