Let's add "Whichever comes first." to that line and we've got a winner. At 100 jumps, she was lucky she hadn't "needed them" yet, but naiive as she hadn't "read something, or heard something." Again I repeat, it's not that I don't understand your point. You present a very sound possibility as to how this happened. But you do so, sorta in an absolving way... Taking responsibility away from the jumper. Like an accidental shooting and: "He didn't know it was loaded!". Well that works if you tossed him the gun and it went off when he caught it, but not if he's been totting it around with him for the last month. That's why in my example, I present a student who has been purposely misinformed by her FJC... because by 100 jumps, she ought to have figure it out. I emphasize what I have from your quote, because it is apparent that during her 100 jumps, she did not read something or hear something... I don't know a single skydiver who won't tell you you have to be proactive and self-educating in this sport. Especially after you are solo. My Karma ran over my Dogma!!!

But you may have failed it if you had been visualizing it incorrectly and were unable to re-think it and get it done within those same 10 seconds. Balderdash! I'm sorry, but at 100 jumps, knowing your EPs is all on you. In your mind, it seems you've now escalated your remote "possibility" into a definite "truth" somehow. Let me present this to you: Even if, during the FJC, an instructor purposely misinformed our jumper that the only way to deploy her reserve is to click her heels three times and say "there's no place like home" and she bought it.... at 100 jumps, there is NO EXCUSE for her not educating herself of the correct EP. NONE. People get rusty and people forget stuff! Whether or not this jumper was misinformed during the FJC is irrelevant at 100 jumps, when she ought to have done a whole lot of personal research. So there are two possibilities: If she was taught wrong: She hasn't bothered to do any further research into her gear and into emergency procedures. It is apparent because after 100 jumps, she was unable to perform an EP. Sorry Ian, For some reason, I thought your idea ended there... and that it was downplaying the natural tendencies of the animal, which are just as real as the physical characteristics they were bred to manifest. Some dogs are more prone to violence. Period. I'm not saying all pits are bad. And obviously, a prudent owner can minimize the risk. But they, and similar breeds, have been branded for a reason. They do not have the same chance of going berserk on your neighbors as say, a Golden Retriever... They have a greater chance. Period. It's called Evolution in the hands of human beings. -We took chickens and made them unable to fly due to the excessively large breasts we wished to breed them for. -Cattle does no look at all the same as when we first started breeding it for meat. -It is said that Calcium in Broccoli is down to less then 50% of what it was in 1975 due to it's being bred for appearance (larger, greener) over the years, rather then it's nutritional content. Is it so hard to beleive/accept that the dogs which were bred to be violent... are? My Karma ran over my Dogma!!!

No one is disputing that and the fact that you keep bringing that up tells me you are still missing my point. No no, I'm not. I just keep mentioning it because to me, it's 6 in one, half-dozen in the other. That is, simple freezing isn't much better an excuse then not knowing how to deploy your reserve. As far as the combination lock test goes. We, as skydivers, don't race to unlock a combo-lock in ten seconds before someone kills us. We, as skydivers, freefall at death-defying speeds towards the earth with limited time to enjoy the experience and then deploy a parachute. I would pass your combo lock test if I had visualized it over it again and again in my mind until I lived, breathed, ate and dreamt the very act of entering the combo calmly. (I survived my first malfunction last year because I live, breathe, eat and dream my EPs.) Again, if she knew what the reserve handle was for, then at 100 jumps, she should have already visualized using it time and time again. When the time came, she froze. I was thinking more leniently before, now all I can say is: "Skydiving isn't for everyone." There is no talking (read: typing) responsibility away from her. My Karma ran over my Dogma!!!

Well in that case, my response is a simple: "Skydiving isn't for everyone." Like I said, at 100 jumps, it is impossible to NOT know your reserve ripchord will end the skydive.. no level of inaccuracies during her FJC can amount to that sort of thing. So now your song is that she might have known the reserve handle would do the trick... but she froze when her first (incorrect) action didn't work. Alright, well that was MY guess but still, kinda leads us back to the same response: "Skydiving isn't for everyone." My Karma ran over my Dogma!!!

Take it easy Kelpy... I'm not sure what you're gettin at here. For one theory to work, the other must. If she thought pulling the cutaway was the way to get her reserve out fine. There's a misunderstanding. Does it absolve her? No. But still, there is a misunderstanding. But then you have to ask yourself: After pulling the cutaway and experiencing nothing... why didn't she then go to silver? The answer is one of two: 1) She froze 2) She didn't know what the silver handle was used for or didn't know that it acted independantly of the cutaway/rsl idea. I was pointing out (to Hooknswoop btw, so I understand why you truncate it and misunderstand), that if what hooknswoop is suggesting is true, (she might have learned that all skydivers activate their reserves by pulling the cutaway), then she either didn't know what the reserve handle was for... or she froze when nothing happened. Get off my back with this "no real world experience" already... I had no real world experience with my reserve handle until my first chop either... pst! Nobody does. Anyway, in case you haven't figure it out yet, my point: The reason she didn't pull her reserve handle can only be one of two: 1) she froze 2) She didn't know what the silver handle was used for or didn't know that it acted independantly of the cutaway/rsl idea. Perhaps the employees were just good judges of character? Perhaps he was lying just as the manager suspected... and only actually glued himself after they refused to come in and help? That would make his 'case' stronger right? In my experience with the slimey, you're damned if you do, damned if you don't. There is no correct course of action because it's all pre-planned. You cannot do right until you've actually proven them to be... well, slimey. edited to add: BTW, I am in insurance. My Karma ran over my Dogma!!!

I'm not missing your point. Just disagreeing with it. If something bad happens to you and someone fails to help, it doesn't just become their fault!! It might make them inconsiderate, but it does not make them guilty of the unfortunate event! I can't be more simple then that. NOW... True they (Home Depot) should have helped him right away. They felt bad about the fact that they didn't. This is evident because they offered him $2000 for his time and embarassment. You seem to think they would owe him the lot of his medical expenses. This would mean they were responsible for the unfortunate event in the first place... not the case. My Karma ran over my Dogma!!!

Now Home Depot should spend that $2000 they offered him on "some guys" to send over to his house. Heck, I'd do it for free. Ass-hat. tigra, you're going to have to learn to sniff these ones out. You always route for the underdog and that in itself is praiseworthy to a degree... but I was having fun with you. I wasn't even sure he was a scammer... but I knew in my heart he did not deserve what he was asking for... and I knew in my heart, that Home Depot should not have been made to suffer in the slightest. She didn't do nothing, she pulled her cutaway handle and expected the RSL to activate her reserve. It's not that I don't understand your point Derek... but she cutaway and waited a very long time for the RSL. If she cutaway and expected her RSL to do the trick, what was she thinking after a second or two had passed? Also, for your theory (that responsibility lies within a misunderstanding about her RSL, learned during the FJC) to be sound, it must also mean that she had no idea her reserve handle worked to deploy a reserve.... because she didn't pull it. For her to think: "All I need to do in an emergency is pull the cutaway and presto, all is taken care of, and that's just the way all skydivers do it."... for that to be the case, she would have done all 100 of her jumps not knowing what the shinny metal handle on her left main lift web was for? ...equally irresponsible (if not worse!) if you ask me. I suspect that she had the presence of mind to cutaway and that she expected the reserve to deploy as a result. When it didn't (because she was cutting away a total), it was enough of a shock to instill a panic freeze and that's why she didn't pull her silver handle. We have to stop discussing the possibility that any responsibility lies with the way her FJC was conducted. Okay, so original poster says -Hard Pull, -Second Attempt, -Cutaway.... so if she didn't try more then twice, she had that part right... How the hell did she get to Cypres Firing land before realizing that her reserve wasn't coming out all on it's own? If she was waiting on the RSL, she could not have been waiting for more then a second... otherwise, she'd be expecting that RSL to be several hundred feet long no? No, it make far more sense to me to say she had good focus right up until the part where she cutaway and had no reserve. At which point she froze. IMHO, it is impossible that she wasn't aware pulling the silver handle would have ended the skydive... yet she didn't. What does that tell us? My Karma ran over my Dogma!!!

I would not be calling him a scum sucker if he wasn't out to get more then he is entitled to... scratch that, he is not "entitled" to anything... something bad happened to him, that does not "entitle" him to anyting. tigra argues that Home Depot should pay because of the misunderstanding which had one of their employees fail to come to his aid. The store offered him $2000 and he called it an insult. tigra says she hardly thinks $2000 would cover his medical bills... tigra, so then which is it? Are they responsible for what happened to him or should they just be punished for having him wait an extra 15 minutes? My vote is, they should send "some guys" to his house. Legal loopholes yes. The type that low-lives use to get rich yes. You'll note I didn't say that he didn't have a case on technicality. Just that the store had no responsibility for his being such an idot. And that he should be burried deep in the cold ground for being such a scum sucker. Scam artists too. Doubt it. The type of lowlife that sues for this sort of thing... well they half delight in their own misfortunes. The supervisor could have freed him in 30 seconds flat AND gave him some oral gratification... and there would still be a lawsuit. They offered him $2000 and he called it an "insult"!!! No you misunderstood. I was saying he sat his dumb ass in super glue. And I compared it to the equally stupid act of hitting ones self on the head with a hammer. Of course he's got a legitimate complaint. His ass is sore. What he does not have, is a legitimate accusation that it is Home Depot's responsibility to keep his sorry, foolish butt out of trouble. Newsflash to you, super glue doesn't just appear on toilet seats. I'm not claiming the man did it himself, but if he didn't, it was a delliberate malicious act! The store is responsible for the conditions of the public restroom and that means keeping it clean and up to health standards... not keeping a security guard. The store cannot be deemed responsible for someone's delliberate attack on random bathroom strangers. My Karma ran over my Dogma!!!

Well tigra, we all know how poor the media is with details... but assuming they had 'em right, the clerk told a supervisor and the supervisor thought it was a joke. So nobody "Saw him there and did nothing" . I'm not justifying the supervisor for not double-checking... but I fail to see how this makes the store responsible for this jackass and his failure to take a gander before placing his bare ass somewhere. It is said he had to wait half an hour before he got out. I doubt that the 'damage' done to his rear is any way worse because of this short period of time. (I guess it would seem like an eternity to him though... lol). IOW failure, on the supervisors part, to come to our losers rescue did not make the problem worse. Also, the man sat his bare ass in super glue! He might as well have taken a hammer off the shelf and knocked himself out with it. This is not Home Depots responsibility, it's his inadequacy as a human being. I don't think this type of occurence is mentioned in the employee handbook when you're hired on at Home Depot. That is, they bare (hehee) no responsibility to him and his stupid act. He should consider himself lucky somebody helped him at all.... Not sue the company because they didn't. As far as either employee being burried deep in the ground with him? I'm not sure that would make the world a better place. They aren't the ones trying to earn a fast buck because of misfortune.
