  1. France Surrendered. Apparently some number of French players are refusing to play in their last game of the group stage against South Africa tomorrow. Not sure how many. This to protest Nicholas Anelka getting sent home for fighting with the coach. Wonder if FIFA will let them place more players on the roster. "What if there were no hypothetical questions?"

  13. My understanding is that there was some talk of him trying for the late fall window (I think October?). The problem w/ that is that the balloon was one use only and though the crew tried very hard to deflate it without any stretching or tearing, the designer would still not certify it as safe to make another attempt. The balloons are very expensive so he either needs to buy another one, which he lacks the funding for, or he need to find a whole new balloon crew willing to put him up in a balloon that the designer won't say is safe.   15. I was going to post about the patient-provider part, but you beat me to it. I don't think you could get in trouble in the 2nd part either, at least not for telling a 3rd party they had herpes meds. Maybe if you trespassed on their property to dig through the trash you could get in trouble w/ the trespass.   17. One big problem is that this test of the reserve was being done while the balloon was being inflated. Why all the testing wasn't done earlier, I will never know.   18. At least by the letter of the law it would be admissible in my state. Whether the judge would let you do it or not is an open question. Amazing that judges don't actually follow the laws or procedures they are supposed to. The only exception here is that one part consent recordings are not admissible in divorce proceedings.   23. I did not call him a dirtbag. He is a defendant (or suspect at the time) and he has rights. The only way the Supremem Court makes case law is in the context of particular cases. Sometimes they tailor their rulings very narrowly and sometimes more broadly but they always make law around the circumstances of particular cases. "What if there were no hypothetical questions?"
  24. This guy had two different, but equally effective ways to exercise his right to remain silent: 1) tell them he wanted to remain silent 2) remain silent. He did neither. I have no sympathy for him. "What if there were no hypothetical questions?"
  25. How were the police supposed to know that he wish to exercise his right to remain silent? He apparently was answering some questions. His claim that he wished to remain silent and was exercising that right by remaining silent is just nonsense. Nobody (except the defendant himself and I am not even sure about him) knew that he wished to exercise that right. The defendant had a couple of ways to exercise his right to remain silent: 1) Telling the police he wished to exercise that right or 2) actually remaining silent. He failed to exercise his own rights. This does not even seem controversial to me. "What if there were no hypothetical questions?"
