the Georgia State Patrol has lost to me twice for using their equipment out of specs... judges tend to take the opinion and facts of recognized experts in radar technology over those of an officer who is incapable of answering the most basic questions about how his instrument works or the conditions under which it is accurately, properly used and agrees with the conditions under which the ticket was given on the video from his cruiser. Lies on the part of the officers would be meaningless if you have the evidence to prove your side of the case. Both were thrown out for lack of evidence and I only had to pay court costs. I’ve challenged 6 tickets in various jurisdictions on the basis of improper use of equipment. In 4 of those cases i paid nothing more than court fees, the other two i was cited for 'failure to exercise due caution'. I’ve also been let off with warnings on two occasions when the officer realized he was ‘over his head’ right away. I'm not advocating excessive speeding or tailgating in the rain or otherwise (btw distance from another vehicle applies to object resolution from any angle) I am pointing out that the claims made by LEO's based on their instrument readings cannot always be substantiated. ____________________________________ Those who fail to learn from the past are simply Doomed.

my doctor tells me they can and do, at a little less than 2 months after i femured myself, i could walk without crutches or even a cane for the most part... I'm stretching to get my full range of motion back but the xrays show bone growth is going fabulously... i'm not sure I was in the category Bill is talking about (i'm sure some will disagree ) but it's certainly given me reason (and time) to think about how/why i do things the way i do and how i can improve my approach (by being more aware, more planned and deliberate when taking 'excessive' risks) to help prevent myself from making the same mistakes again. I completely agree Nightingale, i see (saw) the exact same behavior, bad habits/techniques in fencing and kendo.... I think i might be less 'nice' about it though.. after i've made a correction to someone's technique, if they revert to the 'old habit' i make them 'pay' for it right then and everytime they repeat it afterwards. Evidence certainly comes in a variety of forms, however real verifiable evidence can be shown and repeatedly demonstrated by anyone to anyone...it isn’t the sole purview of a single religion or culture. the problem with 'intangibles' is they are subject to the interpretation of every individual..as an experience it certainly has value to the individual. yup and the intensity of the rain overall.. some cops make the mistake of giving tickets that say "such and such speed" when their instrument isnt capabible of determining that beyond reasonable doubt, same things apply if you are clocked while closer than 10 m from a larger vehicle, the resolution on handheld/car mounted emitters isnt that good...... the smart ones give you a ticket for "failure to exercise due caution".
