I know of a peson on the list for being caught taking a piss behind a building. The logic was that he could be seen from some road that was a football field away. Actually the species Bison bison athabascae is not really a Buffalo - gottcha Chuck ...and native only to North America. I wentby the common name for the species. At any rate, it's dang good eatin'! Chuck

Bingo! I am no lawyer but it seems to me, this is a case of sexual molestation, drunk in public, public indecency, sexual assault,... This was not funny and not a prank. There are limits... to everything. People need to understand that. Chuck What some of these people need to know is this. What you think is "funny" can still be a crime. If he was, then that might be a reasonable point to draw the line, and say that he's crossed into a "sexual offense". And I generally agree with that, at least re: guilt or innocence (although I do think it's a reasonable factor to consider at the time of sentencing). Having said that, a key element of every criminal offense is "mens rea", which we refer to as "criminal intent". Intoxication can muddy up the waters enough to make it a tough call for a jury. So the focus should be on whether his conduct did or did not cross the line into being a sexual offense - not just re: the physics of the act itself, but also a factual determination (which really needs to be done by a jury) as to his actual intent. Seems to me. when he un-zipped his britches and flopped-out his genitals, he wasn't intending to play mumbly-peg! Chuck

I do, appreciate your clarifying the 'sex offender' thing. Where I got the idea that it was a sexual type offense was in the video, the 'offender' clearly 'humps' the passed-out guy's face. How do we know that he wasn't trying to 'work' his genitals into the passed-out guy's mouth? Also, I was always told that being drunk is no excuse! I've heard that from judges. I'd like to say, I was not trying to be 'knee-jerk' in my response. I just find these types of things extremely repulsive and down right 'bullying'. Chuck
