If a woman enjoys / is capable of this, what am I to do to please her in a more traditional role? I'm above average, but come on!?!   3. I'm generally thinking of criminal laws, but even then, I like the doctrine of caveat emptor. Rentals would be a contrctual issue. If you aren't willing to abide by the terms within the four corners, don't sign. I know it just wouldnt be right to kill all the stupid people that we meet..   4. I consider that a sign of good law. Does not change with the times. We can only rely on the doctrine that 'ignorance of the law is no excuse' if the law is unchanging and intuitive.   6. Solid. It was just a size question. I've also found that women have varied responses to my ability to flex them independently. Some find it amusing. Some find it weird.   7. I think that case makes sense. I doubt you would find 'sexually assault women' in the duty description or within the 'reasonable' duties of any firefighter. The court / jury found correctly. Often (and I mean OFTEN) cases will make it to the jury because of a question of fact. Those are reserved for the jury. Everyone knows, however, that the Plaintiff (the assaulted woman in this case) is looking for a jury that will be emotionally swayed and reach into the deep pocket of the employer to pull out wads of money. It's just how things are. The Judge passes the buck to the jury and the lawyers battle it out. Clearly, the firefighters should pay and the employer should not (absent other facts), but firefighters just don't make enough money to compensate a victim in this case. As for payola - of course it happens. I know it just wouldnt be right to kill all the stupid people that we meet.. But do you think it would be appropriate to just remove all of the warning labels and let nature take its course.
  8. I don't see us ever returning to the old west...but it was a pretty polite place. Men tipped their hats to ladies and made way for them on the sidewalk. You left your gun in the holster and acted like a polite person unless you wanted twenty other guns pointed at you. Bill the Kid is still notorious because he killed 21 men. Today's serial killers get into triple digits before we can track them down. And they don't necessarily even use firearms. I'm not advocating. Just pointing out facts. If more people in the crowd were armed, the shooter might not have gotten many rounds off...or random fire might have hurt even more. Hard to say in this situation. But we can cite quite a few situations where an armed public could have made a disaster into a much smaller tragedy. Check the front of American Rifleman to verify.     I have a profound appreciation for nice breasts. I generally prefer a nicely formed backside, however. I think the first is more genetic and the second is more indicative of a healthy lifestyle. I am going to guess that if that driver has done it repeatedly (gone a few miles outside his/her route) and been caught by but not corrected (warning, suspension) by the employer it would expose the employer to some responsibility. An excellent argument to make in court. It depends on prior court decisions in that state and what judge you pull. I know it just wouldnt be right to kill all the stupid people that we meet..   13. I quit identifying with Christians years ago. I got tired of seeing their hateful protests at abortion centers. Pictures of dead babies didn't seem right to me. I got tired of being cut off or flipped of on the road and seeing their bumper sticker inviting me to follow them to church. I got tired of having them try to shove their views down my throat. Protesting a funeral is not shameful to anyone associated with the funeral. It is shameful to those who do not respect others enough to give them a peaceful moment of grief.   14. It depends upon how bad the government is. If it's bad enough, they might even go so far as to assist in the overthrow. Fortunately, the checks and balances we have built into our system should prevent the government from ever reaching that point. Check your history. Who do you think generally fuels revolutions? The legislation is ridiculous. The Secret Service already keeps people from carrying around their charges. The other elected officials generally have some form of security in public as well. How do you enforce such a thing? Isn't anyone likely to shoot you really unconcerned that it is illegal to carry the weapon near you? Laws dreamed up in emotional circumstances are usually very, very bad laws. What is really scary is that this guy wants to insulate the government from the people...like nobility...if elected officials are afraid of the electorate, they might want to address the question of why...   15. I think the concept of the laws of Agency (what we are talking about here) are being taken to an extreme. Generally, an employer is responsible for its Agent (employee) when that Agent is acting within the scope of his/her employment. If you are a delivery driver on a route and hit someone, the company is responsible. That is a reasonably expected cost of doing business. If that same delivery driver has gone a few miles outside his/her route to have a quickie with the SO, the Agent has likely gone outside the scope of employment and is on his/her own. Each state interprets this differently, but that is the basic idea. The question is what the attorney can successfully argue the law is in relation to the specific facts of the case before the court. Now - if your personal opinion is that the law is crap and you will not follow the law - and that is discovered in voir dire (jury questioning) - the Judge will likely not let you sit on the jury. No sense going in with a jury that has a built in reason to appeal the eventual decision. The laws of agency are an interesting study and create many areas for heated discussion. They are not, however, nearly as simplistic as some of our participants make them. They generally make sense if you go through them methodically.   17. I haven't paid much attention while shagging tandem rigs. But I would be unsurprised to find a tandem instructor welcoming someone to skydiving when they hit the ground. It is, afterall, one way we introduce people to the sport. I can see the student calling themselves a skydiver. I can see more experienced skydivers calling them a whuffo. It is also in the nature of some people to disparage others in whatever way they can. So, a more experienced person will discredit another's experience even if it is good experience. Sad, but true. I would not have described myself as a skydiver after one tandem, but I would not disagree with someone who did. I know it just wouldnt be right to kill all the stupid people that we meet..   18. I guess everything is dependent on your point of view. I've heard guys say that if you suck one ____, you are gay. One skydive, and you aren't a skydiver? Never really thought about it. I know my first skydive (AFF) was a comlete blur when I hit the ground. Who knows how he remembers it?   19. I suspect they are going to allow him to resign in lieu of prosecution. It's an option allowed under UCMJ. It lets him keep his retirement and go about his business while the service can say he was disciplined. Relief from command is a career terminating event in the first place. He's done and everyone knows it. I think everyone lost something on the altar of PC this time. I know it just wouldnt be right to kill all the stupid people that we meet..   20. I saw quite a bit of 'reading tea leaves' in the beginning of this thread. I'm not sure 'I told you so' is really warranted. We don't know what we don't know. I suggest that would be a good lesson to remember in future posts. Although I tend to be conservative, I figured the odds were in favor of this guy being a right wing nut job when I first heard the story.   21. I thought the remarks were stupid at first. I had never seen the 'crosshairs'. I assumed that the rhetoric about 'targeting' districts was derived from the 'crosshairs'. I went out and googled the map in question. Sure enough. Those are not crosshairs in my book. Moreover, I came across an image of a home-made poster where someone compared a genuine sight reticle with a peace symbol. They clearly mis-represented what was on Palin's website. I think you are going to see what you want to see in most instances. I am ambivalent toward Palin, but an avid shooter. I don't see a sight recticle. I don't see a surveyor's reticle either. It's just a plus sign with a shaded circle on top of the middle of it. Just something to mark a spot like the pushpins used on google earth. I think Palin's camp has won a rather moot point on this one. The media is making much about nothing again. I know it just wouldnt be right to kill all the stupid people that we meet..   22. I would think that her age difference with you would not be something for humor. Certainly something that can be discussed quietly in a safe setting where you assure her that it poses no problem for you or even that you appreciate her maturity. But until she is confident that your relationship is stable, the humor might cause doubts you would rather not have to later deal with. Since you appear to have already made the remark, you might want to watch for an opportunity to have the discussion a bit earlier than it otherwise might have come about. .02 I suck at relationships. I don't think the author had the slightest intent to imply that politicians choose the truth first. Maybe this forum should be named the argument forum or disagreement forum.   24. Just watched the linked video. If they fired him for that, they shot themselves in the face. Looks like he was doing his job. He probably pushed it a little in today's PC world, but he was exerting extra effort. That's becoming too rare. The unintended consequence of this will be stale, automatons that follow PC rules at the expense of personal leadership and style. I've watched too many complete horse's rearends get ahead.
