He is a private seller and does not need an FFL. If he does that frequently enough however, the ATF will ask him what he is doing. I had a buddy that was liquidating his personal collection and sold several weapons over the course of a few weeks. He needed to sell the guns to buy something else and the ATF visited him to ask questions. They 'suggested' he get an FFL, but since he was just selling off his personal collection he didn't need to get one and didn't.
