  1. Its not murder. Its a very difficult decision to make and your friends are in a lot of pain right now. I understand how you feel, but were you there at the hospital with them? Its not a reccommendation that is made lightly, and I'm sure there was overwhelming medical evidence that the baby's condition was not reversible. In spite of your own personal feelings you need to not judge them right now, just be there for them and support them as well as you can. And hug your own kids and be thankful you still have them! Peace to you and your friends- what a horrible thing to have to go through!
  2. Life is very short- that works both ways. You don't need too many negative influences in your life, nor should you give up on a friendship over something small. Look at the big picture and forgive and/or apologize as needed. Some people aren't worth it, others are and only you can make that decision.
  3. The employees need to err on the side of caution for a number of reasons. By not doing so, they exposed Home Depot to a lawsuit. And if Home Depot gets out of paying a large settlement, it will only be because the alleged "victim" is indeed a proven scam artist. Maybe that's not right, but that's the way it is in this country.
  4. See, even if this guy is a scammer, I STILL think the Home Depot employees f'd up. They have to take any cry for help seriously. If he's got a history of gluing himself to toilet seats, Home Depot might have just dodged a bullet. Its not so much about rooting for the underdog as it is being disgusted by blatant incompetence!
  5. You're missing my point- the store employees had an obligation to act whether or not they believed him. By refusing to act, they turned a situation that couldn't really be blamed on the store into one that could.
  6. I saw about 30 seconds of the episode and that's exactly what I thought. Lazy SOB was just making excuses for not working!
  7. Now see, if that's true, that's new information and puts this in a whole different light. IF that's true, he's even more stupid than the clerks who refused to help him. (Because once you go on TV with a story like this, people WILL look into your background!)

Technically they *might* be responsible for what happened because it happened at their store, in much the same way that if someone slips on your stairs, your homeowner's policy would have to pay out. I'm not a lawyer, so I can't say for sure. In most retail stores, when a customer is injured, incident reports will be filled out and in order to avoid bad press or lengthy legal battles, more often than not at the very least, the store will offer to cover medical bills, and they'd also express regret (without admitting blame) that this happened in their store. And that's when they've actually done nothing wrong. In this case, I don't know the "victim" or what his motives are. I'm giving him the benefit of the doubt mainly because two store employees were obviously in the wrong. They were aware of the situation (whether they believed it or not) and they refused to help. If you ask me, that kind of behaviour is just asking for a lawsuit and yes, I believe Home Depot will and should pay for their employees' stupidity. This is not a case they can bring before a jury and win, and I doubt they'll even try. And the reason I think $2,000.00 would not cover his medical bills if because a) they had to take him to the ER in an ambulance and b) with his medical history, I'm sure they ran a ton of tests. As much as I hate frivolous lawsuits and how litigious our society has become, I think this is the WRONG case to start crying enough is enough over.

Actually, there are plenty of extremely intelligent children in poor urban areas, but there is such a disparity in the schools that from a very early age those kids are quite simply not given the same educational opportunities that kids from more aflfuent areas get. Some of it is social and cultural but most stems from the way public schools are funded. Class sizes, student teacher ratios, availibility of books and other equipment- the differences are staggering. I actually think reaching out to these youths in high school is too late.

  12. If for no other reason, they will pay because 2 employees refused to help him when he asked. The Home Depot folks really don't want this to go in front of a jury or get more press than it already has. The guy looks respectable enough and he's got a bad heart; unless he's got a criminal record or nasty skeletons in his closet, the jury will side with him. And if he glued himself to the toilet seat, it should be pretty easy to prove- bring on the CSI crew! I'm pretty sure the article said there were no paper seat covers, but my guess is every Home Depot in the country is being outfitted with them now, and at least for the next few weeks, the bathroom cleaning schedule will be strictly adhered to. (he he, adhered to???) I can just see the inter office memos and bulletins being circulated and posted in the employee break rooms! now! I really do hate frivolous lawsuits but I also hate companies thinking they can get away with anything. The employees were obviously in the wrong.
  13. And the authorities are looking into whether or not the dog(s) had a history of violent behavior. They may file criminal charges against the owner.
  14. The store does have a responsibilty for its employees being idiots. And I doubt $2,000.00 covered his medical expenses. Not knowing anything about the man, I'm not willing to write him off as a scum sucker who deserves to be buried deep in cold ground. Maybe he is a scam artist, but maybe he's just plain pissed at the way he was treated and this is how he's retaliating. (And are you telling me you've never had an urgent need to use a bathroom and sat down a little quicker than you should have? I'm thinking a Home Depot hot dog could do that to anyone!)
  15. Legally, I *think* you are incorrect. It happened in Home Depot's bathroom and therefore at the very least they would be responsible for his medical bills, in much the same way they'd be responsible if he slipped on a wet floor regardless of how the floor got wet. (isn't that why slip and fall cases are so popular with the scam artists?)
  16. OK, I read that part wrong. But the truth is, if the people at Home Depot had behaved differently and treated the man better, I seriously doubt he'd be making the rounds on TV now or suing for $3,000,000.00 simply because it is so embarrassing.
  17. Assuming the media has it right, the clerk saw (or heard) him, and told his supervisor who did nothing. Yes, the store is responsible for that because those two inDUHviduals are employees of the store. They chose to leave a man in distress without investigating any further. Stupid or just plain mean? Either way, the store is responsible for the actions (unaction) of its employees. I don't know how you can argue otherwise. He should have freed himself with a hammer? The man was in a toilet stall, glued to a seat with his pants around his ankles. I don't think he had easy access to a hammer or screw driver. OK, I've never used the men's bathroom at a Home Depot, but I'm pretty sure those are not items they keep in the stalls. Please correct me if I'm wrong about that. Unless they can prove that he glued himself to the toilet seat, he's got a legitimate complaint. $3,000,000.00 is obviously excessive but an apology and something in excess of his medical costs are both in order, and I'll bet if they'd offerred either, he wouldn't be making the rounds on TV now. What they did offer probably did not cover the ambulance ride and ER visit. (An older man with heart trouble? You know they ran a ton of tests before releasing him!) Newsflash, stores are responsible for the conditions of their public restrooms, whether its wet slippery floor or a toilet seat with super glue on it. Home Depot will pay and now they've got bad press to deal with on top of it. Very very stupid.
  18. If for no other reason, they should be liable because they saw him and did NOTHING to help. Another customer had to call 911. Maybe the clerk who found him first and his supervisor who refused to do anything should be buried deep in the ground right along with him.

  21. Actually, the fact that the police fucked up AND put a perjuring detective on the stand DOES negate the mountain of forensic evidence and that more than anything else is why he was acquitted. But of course, a public defender would not have been as successful at discrediting the police and their evidence as a team of high priced attorneys and forensic "experts". It sucks that a murderer went free, but the way the case was mishandled and the fact that it was allowed to happen due to LAPD incompetence is every bit as frightening, IMO. Seems like so many people want to blame race, the "ignorant" jury and OJ's money when the truth is, the LAPD was 100% to blame. And it sure doesn't seem like they've learned anything from it either because they botched the Blake case just as badly!

  24. Well, I was going to say $5.00 but decided Chuck was a little better than most $5.00 wines too! I remember many years ago when I was travelling through Europe with a friend. In France we decided any wine under 10 francs (about a dollar) was swill! We've got to have limits, you know!
  25. It sounds like he's been using you as a super in exchange for a break in your rent, and now he wants to increase the rent. Having HIS cake and eating it too. Why would he deal with all the various issues in the building when you've been doing it and/or putting up with it for two years? I don't care what city you live in or whether its a house or apartment building- the mold, termite and electrical problems are all potentially serious building code violations. If reported, the owner could get hefty fines for any of them, and be legally required to make repairs. And the no heat thing HAS to be illegal. It could very well be that the basement apartment is illegal with or without heat. I realize affordable housing in New York is hard to come by. Rest assured, your landlord knows it too. He can get in trouble for the violations, but you could end up homeless. I think you should speak to an attorney and figure out what your rights are, then go from there. Go ahead and send the letter, but I doubt the landlord will do anything about it.
