The way it works: local or state authorities arrest a suspect. If they think he is illegal they refer it to ICE, or if they have 287g at the jail they check themselves. If the suspect merits deportation, he gets a hearing date (most arrests don't merit deportation according to ICE). Most are bonded out on the local charges and released on own recognizance concerning the immigration hearing. At that point they are released. The state charges are handled completely separately from immigration issues. The state handles the criminal charges. The Feds (don't) handle the immigration. The most common path chosen by illegals is to handle the criminal charges and just avoid the immigration hearing. This is why some places are committing sexual predators to mental health institutions because they have served their prison time but still present a clear and present danger to society. Exactly. It's a comforting thought to keep criminals in jail before trial, right up until you put some thought into it and realize that it doesn't (and shouldn't) work that way. Our system is great because it protects the rights of the accused. Not really. Domestics have to do it in a bunch of places. In North Carolina domestic arrests are held until they see a superior court judge (second level as described above) or for 48 hours, which ever comes first. This is more proof that we need to give real teeth and penalties to the DWI laws, and we need to start taking "fleeing and eluding" type charges seriously. Simple solution: make any DWI after the first conviction a felony. Pass a state law that for any DWI arrest while another DWI is pending there will be no bond until appearing before a judge (not a magistrate or first level judge, but one that hears felonies and has jury trials). Then make fleeing from the cops in a car a high level felony with a fifteen year minimum. See how many want to try their luck running then. The ones that do deserve to be locked up for a decade or more. Of course, it'll never happen because all the lawyers, judges, and legislators know that if they are ever arrested for anything it is likely to be DWI, so they want to leave themselves as much wiggle room as possible while foisting bullshit on the courts so they can look "tough on crime." edit to add (A) Notice nothing above says anything should be different for hispanics, legal or illegal than it is for everyone else. I've seen an instructor shoot like that twice. Both times it was a dumbass student whobdidnt listen to basics, couldn't shoot for shit, and blamed the gun. Instructornshot fine, but when the dumbasses argued, he turned it upside down and still hit in the X ring at 10 yards. So . . . legislation against already illegal weapons is bad? Gun running of illegal weapons is good? It depends on who you call a gun runner. If you mean "straw buyers" then you know from posts here I strongly support forceful prosecution of people who traffic firearms to criminals and who lie on Form 4473. If you mean gun shops who sell lots of guns,very few of which eventually end up in criminal hands, I disagree. Remember this was around the time when certain groups thought it was a good idea to sue gun shops and gun makers out of existence. You know you won't hear me decrying the evil brown people and how they are supposed to be killing this country. What does concern me is what's happening to hospitals and social services along the border. Mexico got out of the social services business years ago, leaving folks to look elsewhere. You realize people who are trying to get into the country illegally don't generally go to the local police when their coyotes screw with them, right? Do you really think El Paso, which shares part of its border with Ciudad Juarez, is as safe as you make it? I mean, hey, I love this country and think it's great, but you don't rub shoulders with "Murder City" without some spilling over. El Paso is also the most patrolled border/port of entry in the country. Then you've got Phoenix, AZ becoming the kidnapping capital of the US, closing national lands, violence against tribal people on the reservation, ranchers being attacked on their own land, massacres happening on a weekly basis, torture and killing of journalists, musicians, and law enforcement, and hey, who wouldn't want to raise kids there? On a more serious note, anyone with the inclination can find stories of cross-border skirmishes, banditos, rustlers, famous/infamous lawmen of dubious legality, and all kinds of colorful characters. You can't argue there hasn't always been violence and crime along the border. The difference lies in large part with the drug trends and GATT and NAFTA. The Mexican economy tanked, the US started the "Drug War," and Miami and the Carribean ratcheted up their patrol. All that (plus classic Mexican corruption) leads to people with no hope and nothing to lose. And is things really are hunky-dory on our side while the south sides goes to hell, why was Pinal County Sheriff Paul Babeu telling reporters in June 2010 that "violence against law enforcement officers and U.S. citizens has increased in the past four months, further underscoring the need to keep the 80 miles of border land off-limits to Americans?" Why did President Calderon say ""I am well aware that over the past year, violence has worsened. But we must battle on.""
