  5. I suppose I should have defined activist judges. The problem I saw with that is the old "defining pornography" paradox. I suppose the best way to start is by stating that when judges "find" new powers for the government or their court, that is activism. Roe v Wade was activism. No where in the constitution can you find "power to decide who gets abortions and when." Next, it is activism when courts look to foreign law and precedent to rationalize their decisions. Their job is clearly to interpret US laws, not to compare US laws to everybody else's. Intervening in elections where no question of law truly exists, or deciding to exclude clear law in favor of "a better idea" is activism. See 2000 presidential election in Florida, or the Torricelli/Lautenberg candidacy for US senate. "Judicial editing" is a good phrase for it, and I agree that it is just as despicable as creating law out of thin air. ------- Yes, Marbury Madison was activist, but there was no avoiding it. The role of the court had to be defined. They used that case to do it. I've always found Miranda to be a little over the top, but prior to it there was too much leniency for law enforcement. Maybe that pendulum is finally losing momentum and will settle in the middle rather than continuing to swing. It's also funny how so many "broad construcitonists," who border on "judicial editors" don't see things quite so broadly with the second amendment. They don't look at intent, don't read the plain language, so what do they see there?   12. I never experienced the failure you describe in the Mossberg 500 or any other pump gun, rifle or shotgun. (of course, I've had plenty of other problems with some of them...) I specifically know that the Mossberg I used didn't have that problem. I know because we used it in a demonstration (ne DEA agents allowed) and had a volunteer rack the slide to throw a dummy shell to another audience member.   14. I recommend the Mossberg 500 to anyoen and everyone. They are absotively posilutely 100% no questions asked reliable. They're not all as smooth as some 870s, but that can be worked on by a competant smith.   16. You may hate to hear it, but I still have no plans to pick up any version or brand of 1911. My next handgun purchase will probably be a pair of Glocks- a full size and a sub-compact to match. Just about all the ones I've seen on shelves are either those huge "fistful" competition things or the small black cylinder with the silver knob. I was looking in this month's American Rifleman and I saw the Safariland Comp I speedloader (page 78). It seems like it would take up a lot less space, but I'm wondering how positive the load would be... Not that I can actually carry right now - twenty some states trust me to carry, but not my own home state of New Jersey - but I was looking into a convenient way to carry five extra.   22. If you read the articles I posted, you'd see that activists and lobbyists are the problem and the bureaucrats who bow to them. This is a state issue. It doesn't even relate to the federal government (except that federal money should be withheld until things are set right). We can debate Bush policis and turn this into another useless "Bush is evil vs. Bush is the savior" thread, but I don't want to go there. At least the presidency comes up for re-eleciton every four years. The situation I brought up with this thread is bureaucrats changing the rules when science suddenly doesn't support their stance.
