Based on the very brief facts reported with that article the defendant was not actually invoking his right to be silent by being silent. He was periodically answering questions. This case may not have much value as precedence, as the facts may not support the claim of the defendant. Hard to tell without knowing a more complete history and reading the decision. Family asked to pay for car damage after dog run over
Southern_Man replied to JohnRich's topic in Speakers Corner
In many (most?) states homeowners insurance or renters insurance would also cover damages by the dog, so it might well end up w/ one insurance company suing the other one or one company deciding it wasn't worth it to pursue. "What if there were no hypothetical questions?" -

Does the state legally own the deer? Legally the state does claim to own the deer. It is part of how they license hunters (and fishermen, doesn't just apply to deer). It is a bit of a legal fiction of course. The state does not allow themselves to be sued for damage created by animal. "What if there were no hypothetical questions?" -
Charlie Francis who was Ben Johnson's [disgraced 100m gold medalist in 1988 games] coach defended the decision to encourage athletes to dope by saying, "It is a level playing field, it's just not the field you thought it was" BTW, Charlie Francis just died last week. Unrepentant to the end. "What if there were no hypothetical questions?"

They had a segment about this on the morning news on whatever station I had on this AM (NBC, I think). I rarely eat out and try to avoid prepared foods at home. The sodium bothers me a lot more than the calories, I just don't feel good after I eat something like that. "What if there were no hypothetical questions?"

A well reasoned argument on the Rand Paul controversy
Southern_Man replied to jdfreefly's topic in Speakers Corner
IMHO, even in saying this, which I think most people? on this board believe, from the tenor of the comments, is to admit that government action has played an important role in changes societal attitudes about race. Opinions didn't just change themselves from 1964 until today with no outside input, the facts of integration in neighborhoods, classrooms, and workplaces that flowed from the Civil Rights Act changed the way people thought. If now we do not think businesses would immediately go back to discriminating on the basis of race it is only because powerful government action has forced people to confront the relative costs and benefits of segregation vs. integration. Article IV, Section 1 of the Constitution - the "Full Faith and Credit" clause. "Full faith and credit shall be given in each state to the public acts, records, and judicial proceedings of every other state." That means that your driver's license (or other state-issued ID) *is* your "national ID card". Yes indeed. I don't recall being asked for any proof of identity when I got my first US drivers license beyond a couple of utility bills with my address on. Of course, that was a while ago. I had to show my birth certificate. That, was a looong time ago. How things have changed. Chuck Not every state restricts driver's licenses to citizenship. It may (is supposed to be) proof of identity. There is also no requirement for anybody (citizen) to have a driver's license or state issued ID card. "What if there were no hypothetical questions?"

Why does Mexico encourage immigration into the US?
Southern_Man replied to turtlespeed's topic in Speakers Corner
Yes, there was actually a slight "outflow" last year of illegal immigrants as the economy was so bad. "What if there were no hypothetical questions?" -
Why does Mexico encourage immigration into the US?

More economic opportunity. People working in U.S. send remittances to their family in Mexico. Having a bunch of people w/ very poor economic prospects sitting around is not good for societal stability--some level of immigration helps ease the pressure. Best exercises for skydiving?
Southern_Man replied to Southern_Man's topic in General Skydiving Discussions
I appreciate all of the suggestions. I am sure some yoga or equivalent would help my performance in freefall. I'm not the most flexible person (but not the least either). I do some stretching already. I am more interested in weights because it seems that's where my biggest weakness/limitation lies. As a distance runner I have poor upper body strength and the time under canopy can really make me tired after several jumps. I don't think I'm getting enough reps under canopy to build strength that way. "What if there were no hypothetical questions?" -

Eh, arguing in Speaker's corner is like this for both sides. You get to the end, you might feel better but you really haven't accomplished anything. "What if there were no hypothetical questions?"

According to our employee manual I would be better off doing meth or lines of coke off my desk then I would be falling asleep in my office chair. Treatment for substance abuse vs. being fired. "What if there were no hypothetical questions?"

I've seen far more of the inside of courtrooms then I would care to in both work and personal situations. I agree w/ Andy, the cop is going to make up a justification after the fact adn the judge is going to accept whatever justification the officer makes up the vast majority of the time. Most defendants are not going to have the resources to appeal even if they want to and are right. "What if there were no hypothetical questions?"

Best exercises for skydiving?
Southern_Man replied to Southern_Man's topic in General Skydiving Discussions
I am interested in the best weight exercises to help w/ general muscle strength and endurance for a big skydiving weekend. My main exercise is running, so while I am fit I don't have as much upper body strength as some people and my arms get tired after a full weekend (especially if I do a high pull or have to fly in brakes a long way, etc). I do a little weight lifting during the week to supplement my running and was interested to know what the best exercises were to increase strength and endurance for skydiving so I can tweak my routine. Thanks in advance. "What if there were no hypothetical questions?" -
Very inconsiderate. Nothing anybody has to say to me is so important that it can't wait 10 minutes while they go to the bathroom. Seriously makes me want to punch people in the face when I see the guy at the urinal w/ his phone to his ear talking while taking a leak. "What if there were no hypothetical questions?"
