Okay Georgie, maybe it is a comprehension problem on your behalf as I believe that I have answered your question. You want to know what rights have been violated? I believe it was an attempt to search personal property withouut reasonable cause. Once the transaction of full payment has been made the goods purchased becomes the sole property of the person making the payment. If a store asked to pat you down would you allow that? I see it as the same as asking to inspect my purchase for stolen property. I know the law in the state inwhich I live and now I know a lot more about the law in Ohio after reading the codes. I suggest that you do the same. How is it his obligation to seek out the stores policy towards unwarranted search? Do you walk into a store and immediatly ask for their policies? If a store wants me to be aware that I may be searched they need to hang a sign at the entrance informing me beforehand. Not while I am leaving after patronizing their establishment. Little Johnny wants to be a bus driver, just like his dad, when he grows up. He figures he'd get a start on being a good one and practice bus driving on his tricycle. Starting from his room he pedals out into the hallway and eventually arrives at a door. He stops and acts as if he is opening the bus door. "SHHHHHHISH (door sound)". He does not have to prove that he is not a thief if he is not arrested and charged for such. Regardless of the stores policy, he does not have to abide to such a request. Were they stopping each and every person and searching their receipts and bags? I doubt it. If he does not like the policy now that he is aware of it, sure, he can go else where. Apparantly, his policy is to not to give in to being search. If the store does not like his policy, they should had not let him into their store. Oh, I know what your question to this is. Why would they need to see his receipt? They apparantly didn't witness anything otherwise he would had been arrested for shoplifting. And only his rights were violated. Thinking a person is stealing is far different from knowing. They can think all day but, thinking is not reasonable cause. This kid appears to be far smarter than that. Just do a search on him. From what I have read, I would find it hard to believe that he would spout off a list of curse words. By all accounts he is an intelligent kid. He admits that his day would had gone far better had he gave in to the stores demands but, he believes he is right and that a search of his receipt and purchase was out of line. So...? You've never got into a car that pulled up to the front of a store? If you have, are you a thief? They didn't call because they were grasping at straw with the hope to catch a thief. I've had the alarm go off on me several times over the years. The clerks were always nice and checked to see which sensor wasn't deactivated and I was on my way. Of course this is far different from some bozo accussing a person by the act of demanding to search his/her bags. The alarm alert is understandable. A demand to be searched is not. He did cooperate within the boundaries of the law. We are not required to hand over paper to an officer. Be it a DL, passport or birth certificate. I went 12 years without a DL. Should I be arrested if not able to hand over a DL if requested to do so? The charge against him is a trumped up general purpose charge. The cop has nothing and is only wasting the taxpayers money. Then you should be fine with curcuit city searching your car to make sure that you have not been placing stolen items in your trunk throughout the day. Maybe you would be happy to have them come to your house to make sure that you didn't steal your TV from their store. Would you allow them to search your purse. If they want to enforce any type of policy then they need inform shoppers before shoppers enter their store. It is not my job to search out their policy. If I am not stealing and they have no proof that I did, well, they can just go suck themselves. If some moron rent-a-pig was to place his/her hands on me, that is assualt and I will press for charges. They have no right to just choose who to harass at random with the hope of catching someone. The store should place a lawyer outside their door to explain to each and every customer exactly what the stores policy is. Would you be okay with the police searching your car after being pulled over for a burnt out tail light? Would you mind if the government wished to place cameras throughout your house? Would you be fine with being strip searched just to make sure you are not hiding something when you are doing nothing but walking down the street? Maybe you should volunteer to have your phone bugged. After all, if you have nothing to hide, you should be alright with being monitored 24 hour a day. Right? I once refused to let the cops search my car after being pulled over on a traffic violation. They called in the dogs and wasted a crap load of man hours that would had been better spent actually doing their fucking jobs. Just finished reading the Missouri Drivers Handbook last week. Had to take the written and driving test after a 12 year revocation for DWI's (2 extra years for driving while revoked, twice).
