How could this scenario possibly be managed? You'd have thousands of people, each wanting to get his/her entitlement to "just a sec" worth of heckling. And the speech would never happen. The purpose of the speech BY someone is the speech BY that person -- NOT as a forum for opposing viewpoints. They can be made and expressed in coffeehouses, offices, newspaper editorials, on streetcorners... As I said above, No. But this is where you have to look at this particular case and not let yourself get sucked into "the analogy game". If Sheehan (or for that matter Mrs Young) had simply sat there wearing that particular shirt and otherwise behaved herself, I personally don't think that would have disrupted the President's speech one iota. No, except to turn attention away from the president and what he said, in the next day's media circus where all anyone can talk about is Cindy Sheehan and the message on the shirt she got away with wearing during the president's speech. It's a disruption if it is likely to cause more attention to be focused on the idiots wearing the shirts than on the actual event that is supposed to be taking place. If you go to a fancy restaurant wearing an "I'm with stupid" t-shirt when the establishment has a formal-attire stipulation, it is NOT a violation of your first amendment rights if they refuse you service or entry. Likewise, conduct (which can include what you are wearing, particularly if it articulates a statement) can be restricted at functions like the state-of-the-union address. What if they had been wearing plain clothes, but wouldn't stop SPEAKING during the address? SPEAKING is far more clearly identifiable as "free speech" than a t-shirt is -- and surely they would have been ejected for not shutting up. I don't see the difference, and I don't see the problem. No one is telling them they can't go on talk shows and air their statements, or wear the shirts on the street, or publish their views in blogs and newspapers... There is no violation of "free speech" there -- especially since the prohibition is against congress making a LAW restricting freedom of speech and of the press... Cases like this scream advocacy for the viewpoint of the death-penalty supporters. In a world where some schmuck bleeding-heart judge/jury/court/justic system can give someone who took part in such heinous crimes a mere 12 years in prison -- and a chance at a life afterward -- the only true justice really would be execution for such a criminal. Sicker than these disgusting murderers is the fact that some people out there consider them to be worthy human lives, people to be loved, understood, protected, championed -- just as much as those who were killed by them (or sometimes more so ). Some people's priorities are ass-backward, and they care for criminals, rather than for their victims. I think that as long as we let people who are soft on such vicious degenerates run things, we will suffer more at their hands than if we took an iron-fisted approach to dealing with them. - -Jeffrey "With tha thoughts of a militant mind... I was pretty big on "M.A.S.K." and "Voltron, myself. Oh, and here's a real sleeper -- "The Galaxy Rangers"!! That was the best! They integrated some computer graphics into it on occasion, and that made it really cool. And there was the "Silverhawks" as well. Well, I still find it hard to stomach the idea of a nation's people paying millions of their own dollars every year to keep a figurehead living the life of...well, royalty. It's a sickening idea. Oddly enough, cigarette smoke really annoys me, but I find cigar smoke to be quite pleasant. Edit: as long as it's not the cheap shit. I like pipe smoke, and clove cigarettes, but I detest the smell of cigar smoke.
