  7. Sounds more and more like it's our marathon bombers. Apparently this all started with a carjacking at a gas station, or possibly a poorly reported car theft. Now they're pushing reporters further back, talking about confirmed IEDs and long guns. Multiple SWAT units responding, an incident command truck on scene. (I'm not saying it is the bombers, just more and more info coming in and none of it points AWAY from it being the guys) Also, a dispatcher used the phrase "middle eastern male, clean shaven".   11. During a stop, I completely agree with you. However, we are talking about a person who has been arrested for DWI. At that point, in every state I know of, you are required to provide a sample for testing. Some require breath. Some allow officer to choose blood or breath. Some specifically prohibit blood without a warrant. The one constant is that you have to give a sample, refusal will be offered as evidence of guilt at trial (no 5th Am protections here), and even if you refuse they can get a warrant to compel you and take it by force if necessary. witty subliminal message Guard your honor, let your reputation fall where it will, and outlast the bastards. 1*

  13. Honestly I'm not as happy as you are, for two reasons. First, SCOTUS punted on the issue. They didn't clear it up at all, other than saying "no" in this one case. There are no clear guidelines for LEOs. Second, I am a firm believer in "implied consent" laws as related to driving and DWI testing. I am a firm believer that officers should test blood if a DWI suspect refuses the breath test.   15. That honestly surprised me. I expected them to take the case. It is a direct question about the breadth of and limits to a constitutional right, and the appellate courts are divided. For a "shoot/don't shoot" training scenario, you have to have realistic targets that are similar to each other except for weapons. If your armed "shoot" target has rings, the "don't shoot" has to have rings too. So it wasn't a picture of the "victim", it was a picture referencing that FL situation. And FYI, it was a "Don't Shoot" target. In a effort to improve training and move away from the old 'stand in a line and fire on command' range practice, instructors use shoot/don't-shoot targets. Some are armed, others are not. It allows officers to practice evaluating a target before during and after shooting. So this target that referenced Trayvon without resembling him was to teach officers NOT to shoot.
