I'm not going to bash you Andy. It's nice to discuss a subject with an intelligent and informed individual with whom you disagree. As you know, nice can be tough to find in forums. I'm aware of the federal laws covering any transfer o firearms, not just sales. I'm more concerned about selective or overreaching enforcement by a certain federal agency. BATFE is not exactly known for reasonable, consistent, or even legal actions. However, I'm surprised you suggest a waiting period. The USA did use waiting periods before the instant check. The waiting period is unnecessary. NICS is superior and removes the need to prevent people from going without. What we do need is better database management and information inclusion. We also need a way for private citizens to use the NICS. No "whys" just a yes or no. And like I said (but you omitted) that has nothing to do with gun shows. You can call it the private transfer loophole, or some other name, but don't limit it to gun shows. Doing that is the old gun-banner strategy of attacking piecemeal. If they ban private sales at gun shows, the next step would be creating a so called "back alley" loop hole. Or maybe a "living room" loophole. If your goal is to control or prevent all private sales, then say so. If you want to talk about lies under other names, then lets talk about the BS of dealers selling without background checks. It doesn't happen. No FFL dealer will ever sell a gun without a check. No conspiracy, just your average everyday lazy incomplete article masquerading as journalism. First of all, there is no gun show loophole. Private sales are legal in this country; location has nothing to do with it. Also, who said it was going to be private to private sales? Maybe he was planning to sell to a dealer? Next, I've been to that NC show. They have signs posted forbidding loaded firearms. Under NC law, even though he had permission to be there, by engaging in prohibited behavior, he's guilty of second degree trespassing. He's also guilty of reckless endangerment. I don't know that any LEO charged him or the Wake ADA will prosecute him, but I do expect lawsuits. Your problem is not that three idiots out of tens of millions of gun owners were responsible for a negligent discharge. Your problem is that you want the government involved in every single firearms transaction, and it sounds like you want universal registration. Yes? Wow, I wonder who paid for the Bama win. That's three horrendous calls already. Even the announcers are saying the refs are screwing the pooch. That instant replay didn't overrule a clearly incorrect on-field call makes me ask WTF?!? ETA: Bad calls are (1) calling ND80 no-catch on third down forcing a punt. (2) calling a faircatch contact penalty and no fumble on the punt, and (3) giving Bama a first down on third that should have been 4th and punt. Way to hand the game to a team instead of at least making them win it on their own. ETA more: This is just friggin ridiculous. At least they're going to review the terrible call of (4) fumble when the knee was clearly down before the ball came out. Actually, the LEOs job is to protect life, public peace, and property, in that order. They are not there just to "intervene". That being said, I tend to support officers who fired in the line of duty until something compelling demonstrates they were horribly wrong. e.g. I initially supported the NO Katrina cops who fired on people at Danziger Bridge; it later came out they were liars and murderers, and I was glad to see them get what they got (wish it was more, actually). ps - You realize most cops can't shoot for shit, right? Most departments don't train hard enough, long enough, or thoroughly enough during their academy training, and very few have any significant in service training. The vast majority merely go through "qualification" motions. You know, where 70% is good enough. It's up to officer to make up the difference. Like someone said who cares if it makes every situation better, as long as it doesn't make it worse. Can you show where it has made it worse? To a more or less era-equivalent extent, what we're talking about here was done by Abraham Lincoln, Woodrow Wilson and FDR, and that was before J. Edgar Hoover was given free rein to do much the same. US citizens and their agents of European ancestry were responsible for the slow genocide of millions of Native Americans. Absolutely true. While there are criminal charges brought to trial on nothing more than statements/testimony, they usually involve direct eye witnesses who give statements directly implicating the accused. Do you think the state should routinely arrest, charge, and try suspects when the suspect's statement does not imply guilt, there is no witness that contradicts the suspect's statement, and there is no evidence that contradicts the statement or implies guilt? No. If you ignore all spoken "recollection" statements as evidence, you still have as physical evidence: the gun, the bullet, and stippling on TM, the angle of entry into TM, an other injuries (or lack thereof) and items noted by the medical examiner after autopsy. After that, but before getting into "interested party" statements (those by victims, suspects, and people favoring one or the other) you have police reports, the statements made to police by disinterested witnesses, THEN you have the 9-1-1 call and the photographs of GZ. I've long believed that any time an LEO *knowingly* frames or falsely arrests someone, the LEO should get the same punishment as the charges he filed. The problem is if the department supports or instructs such action (with PD lawyer approval). It may be disgusting to the average citizen, and overturned when you get a REALLY good test case like this, but no officer is going to refuse a direct order from a supervisor that's cleared by the lawyer. Not if he wants to keep his job, anyway. Also, you're trusting a media account. Unless you read a DPD press release or perused the court documents, you only know what the reporters/editors want you to hear. And their job is what? Selling advertising.
