If this is true, things will get more interesting. Those cops will have the best defense possible, and eventually the actual facts will matter, and have to be decided on by a jury. A hastened and potentially politically motivated prosecution hurts the case, doesn't help it. On a side note..... The Baltimore mayor is looking more like Ray Nagin everyday.   8. The only difference between Bill Maher and Michael Moore............? About 250lbs. They are professional trolls. As far as using leverage against suspects, no it's not unusual at all. And I'm not saying it's improper, but I think in a strategic sense it is a mistake in the manner in which it was done. Mark my words, the Baltimore PD will become reactive for the next several months, sitting back an answering radio calls. Watch what happens to the crime rate in Baltimore, especially the homicide rate. It happened in Cincinnati after the riots there. The victims of this increase in crime will be the very same people the prosecutor says she is trying to help. That is a political decision, one that will cost dearly. Hammer the guys for what happened after the arrest, I'm good with that if there was misconduct. Again all the facts haven't come out yet, it will be interesting to say the least. In some states it is illegal to flee from the police, even with just the threshold of reasonable suspicion. I can't speak for Maryland. "Just 'cause I'm simple, don't mean I'm stewpid!"
  9. Manslaughter something (don't know Maryland laws) for whomever made the decision not to seek medical attention. The van driver remains to be seen, if he did something intentional, then hammer him, if not the same as above. The rest should be fired and forced to testify against the person(s) who made the decision in lieu of charges. I understand her charging everyone, it allows her to have leverage, but IMHO doesn't make it right. I believe it was politically motivated, and in the end does more harm than good to the community at large. "Just 'cause I'm simple, don't mean I'm stewpid!"
  10. Well no shit. The prosecutor denied probable cause for the arrest why? Because she can, now she will use that as leverage in criminal proceedings against the cops. This is now as much of a political issue, as a legal one. I love to hear many talk about the "Thin Blue Line", there really isn't one regarding misconduct. One or more of these guys will roll on the other, I've seen it happen before. They are just like anyone else when faced with legal pressure. But there are two sides to every story as well, once facts actually matter, it will be interesting how this shakes out. The officers willfully violating policy will be the key to who gets jammed up the worst. This decision is going to be just one of the things that is going to help this thing get uglier than it already is. "Just 'cause I'm simple, don't mean I'm stewpid!"

  14. I've been doing Terry since you've been chasing ambulances, and I agree with what you are saying to a point. One of my Terry stops (and subsequent drug arrest) went to our state Supreme Court, was upheld at every level. Don't need a lecture, "just walking to the corner store" is bull, and you know it. It's the totality of the circumstances, and high crime areas just aren't black and Hispanic. Smoke and mirrors may work on juries.......................   15. Which apparently wasn't very good, Not a good idea to run from bike guys, when I was a bike guy, I chased a dude 7 blocks. I was in really good shape, what I lacked in speed, I made up for in endurance.............. "Just 'cause I'm simple, don't mean I'm stewpid!"
  16. Uhhh, You don't know what else transpired, neither do I, it's the totality of the circumstances. The guy was a career criminal, he started this whole situation by running and previously engaging in criminal activity, ALOT. The cops failed to render aid, they also failed in their moral, ethical, and professional standards to stop the chain of events unfolding by apparently willfully violating policy.   18. If you were a prior contact criminal, acting suspicious, in a high crime area, well then yes, I'd chase you........... At this point in my career, I'd have the young guys chase you. I'll give you two examples, that actually happened to me, during Terry Stops. It's 2:30am in a dark residential alley, I see a guy sneaking around looking in back yards. I watch him a while and he continues to do this for several minutes. I sneak up on him and stop him in the alley, once I get up to him his hair is messed up, his shirt kinda wrinkled, and his eyes puffy. I ask him for ID and ask him what he is doing. He says he lives down the street and his dog got out, he was looking for it. His ID says he lives down the street, we go to his house and his back door is wide open and his wife immediately asks if we found the dog. Reasonable suspicion, he could have been committing crimes or about to commit a crime, he wasn't and we both went on our way. I see a guy in the middle of the afternoon walking down the street with a pillow case, there is a home stereo in the case. The guy is a known offender for drugs and theft. I stop him and he says "I'm moving dude, my old lady kicked me out", he is a transient type guy. I check him for warrants, he was clear, and I'm just about ready to send him on his way. Another guy comes running down the street yelling, "that guy just broke into my house". I detain the guy and go to the house, the front storm door is kicked in, the stereo is missing and so is one pillow case, which matches the one my bad guy has. Those are the essence of Terry Stops, they occur thousands of times daily. "Just 'cause I'm simple, don't mean I'm stewpid!"

Read Terry vs. Ohio The guy is a known criminal, acting suspiciously , all you need is reasonable suspicion to stop him and ask him why he is running or acting in that way. The area he was in was also a high crime area. If he refused to stop then legal consequences apply, he can be forcibly stopped with reasonable suspicion.   20. Yep, Very accurate post. This one is very simple, the guy claimed he was injured initially, they apparently refused him medical attention. I'm sure it's their policy to get a medical evaluation if someone claims an injury, especially after a use of force. Even if that claim is complete bullshit, which in many cases a bad guy is just prolonging the inevitable. In this case the guy was apparently actually injured, and they blew it off. If they would have called a squad (parlance around here for an ambulance), this whole thing wouldn't have happened. That is the way the prosecutor is looking at it, and she is coming after everyone with guns blazing. Their wanton violation of policy is going to get them hammered.   24. ***Yup. Fails to mention how cops investigate complaints against cops. Funny enough when those cops investigate their buddies, they often find there is no merit to any complaint. Interesting that when it goes to trial, all of a sudden the complaints have merit according to juries*** These aren't all juries, most are settlements, in many of those cases, settling is simply a business decision usually by the insurance carrier. Most of the time is more cost effective to settle than take it to trial. They do not mention the cases where a jury decided in the officers favor. Believe me, I've been through it both ways. There are certain attorneys that treat the civil courts as the lottery. I've never once said there were not problems, but I maintain the problem is not nearly as widespread as the media portrays, and the "misconduct" numbers are on par or lower than other professions. My take on the Baltimore incident is this, the guy had been arrested 18 times since 2007. They probably had dealt with him before and he ran and resisted, during that resistance he was injured. I believe the cops thought he was faking trying to get out of his situation, he wasn't faking and now we have this. They are all going to get jammed up for not seeking immediate medical attention, I'm sure that is there policy and they violated it. This policy violation will relate to criminal prosecution as well.
