  2. By the "letter of the law" non-transferable means you can not exchange them, and the reason is what I stated above. That being said, if they are given away or "traded" for a 6 pack of beer or a couple pack jobs (things of little or no value) we do not have a problem with an exchange. Another example would be you won a UPT certificate, but have a brand new container, and someone else won a Vigil Certificate, but already has an AAD. It this case a trade would be completely acceptable. UPT's stance on the certificates is we do not want you profiting from the sale (acting as a dealer who is doing nothing) but we would like the certificates to be used by someone looking to purchase a container.   5. Well, if the uppers are posted (I have not been to a drop zone where I could not get that information) then I know what the timing should be based on the forecast. I am also more than capable of sticking my head out the door and verifying that the plane has traveled at least .2 miles over the ground since the last group exited.   6. This is what my drop zone does. It works. Yes, to answer Kallend's next point, we allow a few extra seconds for larger groups (it is not a problem as a larger group or two means you have less groups overall, so jump run doesn't get strung out as far). Not sure why every drop zone doesn't do this? At least the ones w/ GPS or otherwise able to give an accurate ground speed. "What if there were no hypothetical questions?"
  7. Like I said, I'm not saying it doesn't happen - just that it's not the norm. You're certain of that? Or are you presuming? How many surveys of men married, say, 15+ or 20+ years do you base that on? Well, the perception of it being used as a weapon would be very subjective, so you would likely have to survey both the men and the women separately I would think.   8. Andy, I am thankful for your effort to clarify the law. For better or worse it appears that this case will never have complete and unambiguous facts. The burden and standard of proof and who bears it are very important to an understanding of the implications. I did a little reading about the Stand Your Ground jurisprudence in FL and best I can tell it can be described as unsettled. I read the link andy908 posted about self-defense and it appears FL has a relatively low burden for an affirmative defense. I agree a FL attorney could probably do us a world of good.   12. A) I have no idea what the fuck you are responding to. B) Zimmerman, as shown by people who are trying to prove he's not white, is at least half white. Like, central european white. So, why is he not WHITE? And if he's not, what is he? Obama's mother is white, so Obama is half white. So when he started bombing Libya, do we say, "Oh look, another rich white guy in the white house dropping bombs on poor black people again."?   14. Unfortunately I think it is likely that the facts will never all be known. Makes it a bit of a Roschach test, I think. We know Zimmermann got out of his vehicle and followed the dude at some point, we know there was a scuffle at some point (and apparently Z was getting the worst of that), we know that Zimmerman shot Martin. Between those things there is a lot of fill-in-the-blank going on. I have a question for the attorneys, though. My belief was that self-defense in a case like this was an affirmative defense, which would shift the burden to Zimmerman to establish certain elements of his defense. Is that correct? Of does the prosecution have to estbalish that Zimmerman was "not" in fear of his life? "What if there were no hypothetical questions?"
  15. Whatever you want to call it, the reason that a medical is required at any level is because there is a passenger involved. No other jumper or instructor is required to have a medical, but a TI is directly repsonsible for the delivery of the student to the ground, and is therefore required to have a medical. Why a thrid class only? My guess is that because it's limited to one passenger (in the US), and the limited scope of a tandem parachute system. Let's keep in mind the original intent of the FAA was to protect the non-flying public from the aviation community. I don't think it's unreasonable to view a tandem parachute system as less of a risk to the non-flying public than a powered aircraft, so the lower medical requirements fit the bill. Passenger or student, the purpose of the medical is to protect the paying non-slydiver and the non-flying public. I thought the FAA did not require a medical for tandem skydiving? Appears to me the purpose of the medical is to try to insulate the manufacturers from liability. "What if there were no hypothetical questions?"

There are many, many academic studies documenting differential treatment of blacks at every step of the penal system. The statement was about the rate in which blacks are accosted - IOW victimization rates. Wisc's assertion is that blacks are accosted more often than others and implied rather obviously that it was driven by racism, just as he firmly believes this event was. So that leads to the obvious question - is he basing this on any actual facts, or just his gut? And if we accept his premise that attacks on blacks are due to racism, then we obviously need to filter out all the incidents where blacks hurt or kill other blacks. How big a portion does that represent? We're not in the 50s anymore. There's no question about how the South used to be. But let's talk about how it is now.   18. I would bet anybody looking for a "play" canopy is looking for a round. Do these things still hold any value to you at all? For ecample as packing practice, or something like that?   19. For better or worse it is a sign of a fracturing of the republican consensus. Used to be that Democrats were the masters of disorganization, disunity, and dysfunction. Republicans also pushed party rules that pushed up contests that have delegates proportioned by congressional district and pushed back those with winner-take-all contests. Whether good or bad it has tended to blunt momentum and the sense-of-inevitability. I'd argue that is bad for the party, as it has led to more in-fighting and less time to unite behind a candidate. I think it's better for its voters to get away from winner take all rules. When you have 3 major candidates and two of them nearly identical (Santorum+Newt), it would be wrong to give all delegates to Romney for getting 35 or 40% of the vote. At the same time, the GOP continues to be more cohesive in Congress, even if their ability to select a potential President has been MIA since the fall of the Bush dynasty. I understand what you are saying in theory. On the other hand, I sort of think a primary process that more closely mirrors the general election, where almost all the states are winner take all, would be a better test of ability to win a general election. I suspect it means that Living Social told the drop zone they had to discount the package by X% (55% seems to be what it ended up being) so the drop zone figured out how to make the numbers work by throwing in some extras and padding the total, then discounting off the padded total.   23. There is nothing in the law that prohibits anybody (gun bearer or not) from pursuing or confronting anybody else. We may never know the true story of what happened, as only one person is alive to tell his side of the story. It seems established that Zimmerman pursued. Did he confront? Unknown. Is pursuit provocation? Well, it certainly does not legally justify assault of any kind unless there is a threat but if somebody is pursuing me, yes, I believe they are provoking some kind of action.
