Paul - although from the lay perspective, your TERMINOLOGY is correct - in the eyes of the Federal Statute (and most specifically the one this defendent was charged, tried and now convicted under), you are incorrect! Employers ARE considered an "Agent (or instrument in other sections) of Collection" (collection being the operative word here) on behalf of the government, of certain taxes, in certain situations. Payroll being one of them. Therefore when employers are found to fail to pay whichever set of taxes under the law they are emburdened with (as in this case) - they are charged with "Failure to Collect & Pay Taxes", as that is the statute(s) the charge(s) fall under. Direct from the Cato Register, specifically on the topic: As the tax codes became promulgated, ostensibly "withholding" and "collection" became (for purposes of the eventual statute) synonymous. Semantics. I have seen several similar cases in the past & they all read the same. When someone is charged under the federal statute, this is how it reads, simply - in the legal proceedings document. The defendent "failed to collect the taxes on behalf of the US Government". This does NOT mean complicit employees (or they would have been charged/co-defendents too) & that the taxes were not shown as witheld on their paystubs. I do not know anything specific about this case - but in each of the priors I am familiar with, that each also read the exact same way - the employees paychecks did indeed show the witholdings. They simply were just not "collected" - on behalf of the US Government. Thus the charge. (and now conviction) None of us really, can go by merely the mass media - on EITHER side of the positioning of this. Trial transcripts are public record though, as I think someone else has already pointed out. So if there is such an interest in getting right down to absolutely all the nitty-gritty of this one, and we are so empassioned about it - before speaking so emphatically and insistently on either one side or the other of it, without some very real, tangible otherwise 1st-hand personal knowledge (again - on EITHER side of the argument) - perhaps that is what I would suggest. As usual, the mainstream media reports themselves just might not know the full INTERPRETATIONS of what they are just merely "reporting" on either. - Ya think? Or maybe if that is what any of us want to completely RELY upon - none of us really ever have to even further delve into any incidents. Heck, they'd all be solved for us with the mainstream media report(s)! Most famous (and prevalent) mass media quote: "Parachute failed to open." Why not? Please, explain. Is it also not logical to start with a Static Line? Why? Either method(s) are tried, true perfectly VALID FIRST JUMP progression methods. I would actually argue the Opposite, and offer up instead that for someone who already knows they are SERIOUS about actually pursuing the sport right from the get-go especially - that it is Tandem instead, that is entirely ILLogical. Tandem can be done with (relatively) little "training" at all, and sure - might "acclimate" and innoculate SOME to the potential shock of sensory overload - but for the most part (yes, with EXCEPTIONS - those with an actual "teaching" tandem program) is really nothing more than a veritable "carnival ride". A way for those who may just have skydiving on their "bucket list" - to get that checked off, without having to invest much time and attention towards, then move on. Before I am flamed for that - remember I did say there were (and ARE) exceptions! AFF (and Static Line or even IAD for that matter) on the other hand - provide CONSISTENTLY however - an actual TEACHING, FIRST JUMP COURSE. Not, necessarily required at all, in order "to just do" a tandem. I submit that "Logic" therefore supports in this case - absolutely NO NEED for a tandem, and straight to a FULLY INSTRUCTIONAL based FIRST JUMP COURSE (notice the emphasis on what it is even called! ), such as AFF, is in fact - Please - absolutely PERFECTLY acceptable! After all - and as others have mentioned - that is precisely what the entire program was designed for in the very 1st place! Personally - I have never done a tandem, from either "side of the equation", and don't ever plan to either. Just another .02 Blue Skies & GO FOR IT, Boomerang! I believe you are taking BG's quote, and reference here - out of context. And therefore you are misapplying it, where it does not (here, for a beginner/student who does not even have BASIC PATTERN skills) apply. I believe you also need to take into account the context of the lesson (chapter) you are referring to, is (IIRC) in reference to set-ups for HP Landings! This is very specific, and I do not believe applies to the OP's situation. Visual analog altimeters, as are what are USUALLY issued to students, just are not accurate enough below 1k to be RELIABLY used effectively for this purpose. If he has one of the latest, specific to the application digitals, okay then - MAYBE. Otherwise though VB - IMHO, you are mixing apples and oranges, and providing advise that is designed for a specific purpose, then taking that advice and applying it to another purpose entirely - for which it was not intended, nor Germane (yes, bad pun intentional ). coitus non circum - Moab Stone

I think the OP referring to using beepy-things, was meant to dissuade you from becoming Pavlovian. Whether thinking that you are relying on it, or just (even just temporarily) "using it as a crutch" does not matter. Until you have at least 1st learned, and internalized independently with your own eyes, how to fly (and adjust if/when/as necessary) your pattern(s) - using a beepy thing to queue you is, IMHO - bad "training". One day, the beeper will either not go off (batteries die, forgot to turn on or set correctly etc. as has already been mentioned) - or, even the opposite - it does go off, and you JUST REACT - because that is what you have now trained yourself to do. ...And if that reaction would be inappropriate due to other factors or considerations you should be making or taking... ...Oh well. The West Virginia State Quarter, which sports an embossing of the New River Gorge Bridge on its back, initially had a version of it proposed that also embossed upon it - a parachute descending from that bridge, commemorating the biggest annual draw to its states annual "Bridge-Day" celebration there. It sounds to me as if the offense was taken in that you seemed somehow either "trite", or worse yet - ridiculing of the person who did this. Even though you did not mention names, I'm sure at least the DZO knew who was being referred to - and if he/she thought you were merely inferring stupidity on them - he was (albeit himself inappropriately too) "putting you back in your place". This is just how I observe what you say here, occurred. The old addage - two wrongs don't make a right, comes to mind over the interaction. That said, and as others in here have now already pointed out - this type of mis-rigging, then MISSING it, and getting that rig in the air is a very REAL concern. Someone needs to step back just a bit from the "politics" of the who's and the wherefor's posturing taking place now about how it is being handled - and if they are worried about how it is being "communicated", or "getting out there" - then handle that first most DIRECTLY, and PROFESSIONALY (and seriously - with a mind and an eye towards promoting safety 1st) themselves. I'm not reading through this entire thread, as it is clear before I finish even page 1, what it is, and is going to even further - deteriorate into. So, if this is redundant, and been already brought up/"discussed" (such that "discussions" on here can oft times become), my most sincere and profuse of apologies. I note a couple of quotes in here, right on the 1st page (remember, I've not bothered to go any further) several mentions of handles. However, hasn't anyone else in here noticed right from his very FIRST post - top of the string, in the still shot - or frame-grab taken at the moment his helmet was departing, shows CLEARLY that he used his cutaway pillow as an "SOS"? Guess I must be just another of those over 1k jump a-holes, but someone please, close to this jumper - have a talk with him about his EP's, and COMPLETING his procedures.
