They did an alcohol level check on her breast milk? Wow... Sure, you’ve heard of blood alcohol content (BAC) well this is MAC. And then I found this. "There's no level of alcohol in breast milk that's considered safe for a baby to drink. They should have the knowledge to land safely off dz without assistance, shouldn't they? Isn't that taught in the FJC? then they shouldn't need radio at all right? Yep. And as all FJ methods should be teaching, the radio is a backup device only, to assist IF possible. I agree 100%. Funny how in the “Archway Skydiving Sued” thread there are some people that believe (if you follow their train of thought) that if the radio failed because the batteries were incorrectly installed and the student got hurt the radio manufacturer is somehow responsible.

you should have checked your spot and not jumped. especially with your experience. And with your experience, you should know that we don't always get to pick our own spots, especially so on giant big-way dives. Someone else picks the spot, and if you want to succeed in making the group formation, everyone else has to trust that spotter and exit according to plan. You don't have the luxury of every single jumper pausing in the door and looking down, to make their own individual determination about whether or not the spot is good. That's true even on smaller dives, like 20-ways out of an Otter, or an Otter with multiple groups. Sometimes you get the spot that someone else gave you. And since we're all human, sometimes those spots aren't perfect. If you (generic "you") have been in the sport any length of time, and have never made an imperfect spot, don't be too sanctimonious, because sooner or later, you will. What he said. -

A few years ago doing bigways in Florida on an attempted 160 way I went into a cloud a few seconds after break-off. I don’t remember my break-off altitude (5500 maybe) but I was in the second ring. Did my best to stay straight and track my ass off. I knew from our previous jumps as long as the outer ring tracked as they had been I wouldn’t catch them but damn that was scary. Seemed like forever. Didn’t come out of it until I was going through about 2 grand. Took a furious look around while waiving like a madman and dumped. My altitrak reads a deployment altitude of 1620. I landed on the golf course. Dumb, dumb, dumb. We sat for the rest of the day. -
Thanks, Strat...I learned that from you way back and I still do it exactly that way, too. That is how I was taught. No clue I was getting a radio until I was geared up.

I would think following the student would be a good idea unless it is going to put the instructor into a dangerous situation. The student should be trained to land without the radio. Radios fail, off dz landings make radio impossible. With that being said, in this situation I believe it looks like the student is going to make it back to the airport (an airport) if not the landing zone specifically. See attached. The yellow circle is the student, the red circle is the cutaway and the green outline is the end of the runway. If the instructor saw the student was making it to a safe landing area I could see him following the canopy.
