If we know that certain evidence will provide truth why deny it based on procedural stuff. I recall it is about justice, not beauracracy. Actually criminals only differ from the rest of society in that they lack the moral restraint to refrain from taking what others have earned. They have the same mean IQ of society as a whole and the same variance. It is not about satisfying some visceral bloodlust against those who have done wrong. It is about making the criminal justice system an experience that criminals do not want to repeat. raising penalties does work. Some examples; >DUI-This used to merely result in fines. Since they started giving huge fines, jail sentences for repeat offenders, car impounding, criminal records which ruined peoples careers..etc, people have taken greater care to arrange alternative transportation home when they know they will be drinking >Workplace sexual harrasment- At one time a slap on a female coworkers ass would result in minor disciple based on the "boys will be boys" principle. Since people who did that started getting charged, losing their jobs, sued, and most importantly a criminal record for being sex offenders, the problem has diminished (but not disappeared). Criminals will always look at things from a cost benefit analysis. Otherwise, 270 pound body builders would get mugged with the same frequency as 85 year old ladies who weigh 90 pounds. Straw man argument. I merely stated that we should not cease to pursue, because some selfish criminals will take risks with other peoples lives. It is better to come up with a law that places extremely heavy penalties on people who injure/kill people while leading the police on a chase. Drawing a line in the sand would not entirely be a bad idea. I think it's high time that the bad guys were sent a clear message that the good guys are fed up and the party is over. I see that to an extent, but you are speaking from the perspective of someone who respects the law. I do agree that all the penalty in the world means nothing if you will not get caught, but with respect to hardenned criminals I am not sure that the speeding analogy is entirely accurate. Many criminals do factor in minor fines and short jail sentences as the cost of doing business. Marginal benefit vs marginal cost. While you cannot get rid of crime I think that increasing the marginal cost will put some criminals out of the market. That said I think the presence of cops does help deter would be bad guys. Do think we should have more cops walking beats (as opposed to driving around in their bubble(car) so as to increase the presence? That same argument has been used with respect to police chases. The argument that if someone is trying to evade police they are likely to cause a crash so police should not pursue. I disagree. A judge can take into account other factors but once convicted there should be a reverse onus on the defence to explain why the maximum penalty is not required. If you are concerned about criminals reacting violently when cornered then we simply have to increase the penalties for resisting/evading arrest. I am middle ground on this. We do not live in the dark ages so I think burning at the stake, or being stretched on the rack would be gratuitous acts of sadism. That said spending fuckloads of dollars on tring to find ways of making execution pleasant (counsellors on hand for the condemned, choice of last meal, being given drugs in advance to help them feel calm, specialized expensive lethal injection machinery to put him to death peacefully, and endless whining when it appears that one or two of these clowns felt some discomfort.....I mean come on! Yes a fair trial is a must, but whos definition of fair, The victims or perpetrators? That said, after a fair trial, if the person is found guilty, they should receive a sentence that makes them say "Oh shit I do not ever want to be here again", and makes other prospective criminals think twice. Way to heavily in favour of the criminal. I am not draconian but I think with property crimes the perpetrators should not only do some time (hard labour) but they should be financially responsible for replacing the victims property (not the depreciated value....brand new). One minor drawback. This presumes that everyone in your office team will be willing to take up skydiving. Most want to do baseball (or paintball for the more adventurous), and will look at you like you have a cock growing out of your forehead when you ask them to jump out of a plane. Even if you do get initial agreement, many will have sudden "conflicting arrangenments" when the big day approaches. I have had numerous freinds (and groups of freinds) tell me that they were interested and would do it "someday" and someday never came. Many just said no fucking way.
