13 Attorneys General Sue Over Healthcare Overhaul
pmw515 replied to rushmc's topic in Speakers Corner
And I ponder this because of a ruling many years ago when a farmer was forced to pay a fine (by the fed gov) for raising 12 acres of wheat instead of 10. A fine the court upheld..... Although the fine was upheld, the courts did not say he had to grow wheat. They said if he chose to grow it, it was subject to federal regulation under the commerce clause. A fine, or tax (for a lack of health insurance) is not constitutional because we can't chose not to buy health ins. after this law is implemented. That is a lack of activity, the courts have never taxed inactivity under the commerce clause that I am aware of. -
Do you have healthcare currently? What is your view on the bill?
pmw515 replied to bluesilver30's topic in Speakers Corner
Well, I dont have health insurance. I do have access to health care. That said, I oppose this bill because of the unconstitutional mandate to purchase health insurance. When did my lack of health insurance become anyone's problem but mine? I haven't jumped in a long time, but I remember that skydiving is all about personal responsiblity; is life no different? Granted, we nead reform for health insurance; however, should the government provide what we need for us? Is this not an issue of personal responsibilty? I don't own a house, and that's ok because I can't afford one right now. Should the government buy me a house? Of course not. These are my thoughts; I welcome yours. -

I guess you don't like the freedom to spend your money how you please. Want to let the Feds tell you that you must buy what they tell you? (in this case health insurance). What's to stop them from making you buy a gun? You have the right to your property, to liberty, and to life. When the feds start dictating how we can spend our money via a mandate, or punnish us, we are no longer free. Maybe the courts will reverse, maybe not; I hope they do. -
Well, it passed, and that means I have to buy health insurance which I can’t afford. If I could afford it I would buy it. Now I have to figure out how to pay for insurance or I will be fined (which I also can’t afford). I have lost the freedom to choose not to buy something. If this stands, then logically Congress can dictate that I buy anything- a car, a house, a shirt, or anything else they deem is “in my best interest.” Oh well, maybe the courts will reverse, maybe not. This is the worst birthday present I’ve ever received. Happy birthday to me! Rant over.

11 Year Old Boy Charged With Murder As An Adult
pmw515 replied to Andy_Copland's topic in Speakers Corner
I partially agree. Either put him in a juvenile facility until his 18th birthday, or put him in protective custody in an adult facility; he will go to adult prison either way. -
Both sides voted for TARP I. Only 3 Republicans voted for Pelosi's Stimulus Bill.

I think the chungs(?) should sue him. Let him see litigation from the other side. What a dick. We need tort reform badly in this country.

Well, bless my heart. I guess I'm racist, or could it be that I don't agree with Obama's politics? Imagine that! I don't want to be poor.

If a person has to sign a waiver absolving a dropzone, water park, or other entity of liability, and a person is allowed to sue anyway, what was the purpose of the waiver? Are people now so feeble minded that they think "I will sign a waiver, but if I get hurt, I will sue. I will let the government dictate what I can and cannot do because I've been injured?" Along the same logic, if parents signs a waiver for his or her child, the net. Should accept the fact that his or her child may be injured, and they should not sue. That, in my opinion, is personal responsibility on the part of the parent.

I will hopefully have mine in 9 months. Then its on to get some experience in the government sector at any level.
