  3. The 9th Circuit Court of Appeals says the 2nd amendment applies only to states, as a collective right. The 5th Circuit Court of Appeals says the 2nd Amendment applies to citizens, and an individual right. Reading past Supreme Court cases and founding documents, the 5th Circuit is right. The most recent case mentioning the 2nd Amendment is U.S. v. Verdugo-Urquidez (1990). And if you only want to look at Miller, then you have to think every weapon appropriate to a fighting force is covered. Simply, Miller is a poorly reasoned and poorly written decision. Thankfully, there are 30 or so other cases relating to the 2nd Amendment which we can look to for clarification.   4. Sure they can. All it takes is that you care about what you're doing, and do it patiently and attentively. Ask Kennedy or AggieDave if they feel that they could handle a gun 100,000 times and manage to not shoot themselves or something else by accident, and I'm pretty sure they'll say yes. See, when they put a gun in their hands, their minds say, "Well, better do this the right way," and so they do. It's no miracle, no secret, no arcane magic. It's just training and responsible action. I lost count at 100 lbs of lead down range when I was about 15. (yeah, it's nice when relatives own and operate a range) I don't know that I've put 100,000 rounds down range, or even held a gun 100,000 times, but yes, I'm sure I can and will do it safely (unless I die driving on a public street first). The only time I ever shoot something "by accident" is when I miss the bullseye and hit other paper or dirt.   9. OK, here's my bottom line. Skydiving, even if you do everything right, is inherently dangerous. Driving alone on private land is less so, if everything is done right. Driving on public streets is more so, even if everything is done right. Owning a firearm, if all rules of safety are followed, is not dangerous at all. If I go out on my own land and shoot at my private range (hypothetical, I have no land), there is no danger to me. If I carry concealed and go out in public (hypothetical, waiting for sheriff to "permit" me), my own firearm is not dangerous to me. If I keep a firearm in my home (hypothetical, I rent), there is no danger to me. By your definition, EVERYTHING in life is dangerous. Really, can you find anything that is not "able to cause harm?" If everything is done right, skydiving with your own rig can still kill you. If everything is done right, carrying your own firearm cannot kill you.   11. Bill, how many automobiles do you think there are in the US? They "have an incredible capacity to injure and kill when misused," and they were not designed to do so. Every tool has a capacity to injure and kill when misused. For every gun crime or firearm accident you read about, remember that there are more guns in this country than people. That's right, there is at least one gun for every man woman and child. You should also remember that guns prevent 2.5 million crimes every year. Does that make them safe? No. Does that fact that their misuse can hurt you make them dangerous? No. Why not? They can't hurt you. They are an inanimate chunk of metal. Their use does not put you in danger. Think about it. Remember the accident statistics you laughed at? There are more accidental drownings just in buckets than all firearms related accidental deaths.   13. Many police agencies use a similar drum before checking firearms (prior to shift, maintenence, etc). It exists as a failsafe for human stupidity. If an officer unloads his firearm properly, there is no need for the drum. It exists for those few times when idiots show their stripes.   16. You're not doing so well on points of law lately prof. MOST laws, when they are passed, apply to the future. This is circumstance is referred to as ex post facto. Quite simply, when acts are outlawed, those that have already been committed are not crimes (at least, they cannot be punished). John's point is that a person who has commited no crime and takes no new action, who causes no harm an has no intent, is suddenly a criminal.   17. First, congratulations on your decision. Second, for the rifle, well that is just too much to offer suggestions without a long conversation first. For the handgun, Glocks, HKs, Sigs, and Kimbers are all fine firearms. There are other high quality models out there, but they top the list. Para-Ordinance is also making a huge name for themselves. Try out the LDA: "light double action" in their pistols (higher capacity coming soon ). I know a few who swear by their Browning High Powers. I find the grip uncomfortable and the trigger atrocious, but the point is wrap your hands around as many as possible, for as much use as possible. If you consider a revoler, Taurus, S&W, and Sturm Ruger are tops in the industry. (my next purchase will likely be a Taurus 650SS (a 5 round .357 revolver, seen here) Remember, the AWB sunsets in 131 days. That means more for .40s and 9mms.   18. There's the difference. To skydive is to inherently put your life in danger. You are two to three miles above the earth, relying on nylon to save your life. Gun ownership, on the other hand, bears no inherent risks. Gun ownership is like buying a rig, there's nothing dangerous about it. How many times have you heard pulling referred to as saving your own life? Your life is at risk on a skydive, when you use your rig, no two ways about it. Using a firearm, however, does not bring you to danger. That's why I can say gun ownership is less dangerous than skydiving. With gun ownership, if it's just me and the gun, I know I'm going home tonight. With skydiving, the ground is always "pointed at you." The same is not true with firearms.
