why does being prepared for a services outtage mean you have to stockpile weapons? If you believe that the community you live in will ransack your house for your preps, then you need to help them get prepared now while they can, or move to a different community. Stocking food for your family doesn't make you a nutter. Stocking ammo and guns to fend off the attacking hordes makes you paranoid, but just because you're paranoid doesn't mean they aren't out to get you. -- Rob -

I consider the assassin's victims right to live to outweigh your right to convenience. A very smart Supreme Court justice once observed that "The right to swing my fist ends where the other man's nose begins." and do you believe that any justice would remove anyone's second amendment right based on the predictions of an FBI profiler? That seems to be what you're proposing. Yet when I state your apparent position you selectively quote me to dodge that. We will have to take that as assent since it's the closest you'l likely come to stating your actual stance on the issue. Have you ever heard of "due process"? so you're proposing that we profile every citizen based on private actions and when we think they're doing something wrong, convene court, or a panel of some sort to remove their second amendment right. -- Rob

yes, there are profiling experts. so are you proposing we profile every single american based on personal activities and then put them on the NICS list, and if they want to buy a gun they can fight the battle in court? unfortunately, you'd be hard pressed to find a profiler that would feel they are accurate enough to remove someone's rights. That is, unless they're you, but in that case, they won't share the answers. -- Rob

I am under the impression that the photos were turned over after the murders, once the investigation began. Actually, I just re-read one of the articles about this, and it says that he dropped off the roll of film and then later picked it up. So, if the police got the photos from Walgreens, then that implies that Walgreens had kept a copy of them. (Which would be somewhat unethical, but not particularly surprising. However, it's unclear if that is what happened.???) I knew a guy in college who worked at walgreens. He said the photo lab guys has a book with dupes of all the best shots. as you say... not particularly surprising. -- Rob

true, but by the laws in Texas you have to be driving a motor vehicle on a public road and be intoxicated. They claim that a horse & a mule fit the legal definition of "motor vehicle". But the judge had more sense than that. PI and a night in the drunk tank would have been the right way to go. -- Rob

well, the law already reads that way. intentional failure to conceal is an offense. intentional failure to conceal means intentional exposure. the point comes down to the classic "you might beat the rap, but you won't beat the ride". Face it, in the field, it's always officer's discretion. yeah, they might change it to read "unintentional failure to conceal is not an offense", but that's not how laws are written. They define offenses. Not every possible non-offense case. That's what case law is. -- Rob -

got off the phone with my instructor friend. He told me that when he was at a DPS seminar on changes in the carry laws it was discussed and the DPS official (don't have a name) leading the discussion said that accidental exposure would not constitute brandishing. Though the police might get called, and it would be officer discretion on what was accidental or not. If the officer felt it was not accidental, then it would be brandishing, and the judge could decide the rest. None of this changes the recommendation to remain concealed at all times. But it should ease concerns over accidental exposure. (which oddly enough I did last night at a restaurant, but either nobody saw, or nobody cared) -- Rob -

perfectly legal here to open carry long guns. I know a guy who when he found this out, put his AK on his back (slung, unloaded) and hopped on his motorcycle. He pulled up at a light, and a cop pulled up next to him, looked at him, shook his head, and drove off when the light turned. same guy asked me if I wanted to have a picnic at the state capitol with AK's slung across our backs. I declined his invite, but offered to video the whole thing for him. -- Rob -

I'll make a couple of calls. It was a discussion with a police officer and a firearms instructor over beer. the discussion was around the meaning of "intentionally fails to conceal" meaning "intentional exposure". I think "intentionally" was recently (a couple of years ago) added. One of them (I don't recall who at the moment) had said there was a letter from the DPS that went out to instructors. I don't think *accidental* exposure of the handgun/holster like that should be counted as brandishing. It's been determined in TX that accidental exposure is not brandishing. I feel the same though. I carry concealed (licensed) frequently (not daily) but don't think I would open carry. edit to add... TX also has an open carry bill in queue. from what I've heard through some lobbyist friends, it's expected to pass. -- Rob -

I believe stating a 66% increase is a lot more sensational than stating a rise from 3% to 5% ... but it's more accurate than to say "taxes went up 2%," the measured understatement. If my taxes went from $1500 to $2500, I'd want to know what branch of mathmatics says that is a 2% OR a 3-5% increase. That branch would be simple percentages. (5th grade?) if your income is 50000/year, 1% of your income is 500. 3% is 1500. 5% is 2500. -- Rob
