  1. I was going over the California ballot propositions, and this is what I came up with through my own analysis. Knowing there are many very smart Californians here on the board, I figured I would ask for your input prior to filling out my absentee ballot, because you may see something I've missed. This is what I'm thinking: 1A and 3 High speed train and Children's Hospital Bond No. Bond measures are just not a smart way to fund things right now. These may or may not be good ideas, but this is not the right way to pay for it at this point in time. 2 Standards for Confining Farm Animals Yes. If we're going to raise animals for food, we ought to do it humanely. 4 Waiting Period and Parental Notification for Terminating Pregnancy No. You can't legislate proper parenting, and if a pregnant teenager doesn't go running to mom and dad on her own when she finds out she's pregnant, that relationship is already broken. 5 Non-violent Drug Offenses Yes. Savings and outlay look to be about a wash, with a one time savings of $2.5 billion, which we could use right about now, plus I have never liked the idea of throwing people in jail for using drugs absent any other crime. 6 Police and Law Enforcement Funding No. I oppose propositions that remove flexibility from our budget. While funding police and local law enforcement may be a good thing, requiring a set amount each year is not. 7 Renewable Energy Generation No. This will increase utility rates in the short term, which people will have trouble affording in the current economy, cost the state millions to regulate, and has an unknown impact on state and local revenues in the long term. Local governments that provide public utilities are having enough trouble with their budget. Purchasing renewable energy is something they probably cannot afford in the next year. This is probably a good idea, but the 2010 deadline is too soon. 8 Eliminates Right of Same-Sex Couples to Marry No. This will take needed revenue away from state and local governments, and who someone wants to marry is none of my business or anyone else's. 9 Criminal Justice System Victim's Rights - Parole No. There's some good ideas in here, but some bad ideas as well. With our overcrowded prisons, extending the time between parole hearings may not be the best idea, and limiting access to counsel is probably a bad idea. This proposition just suffers from too many issues crammed into one law. 10 Alternative Fuel Vehicles and Renewable Energy No. First off, this is bonds. Bad idea. Also, the state would be forced to help pay for certain vehicles as long as they are not worse polluters than the current standard for gasoline or diesel. While alternative fuel is good, that just doesn't sound like enough of an improvement to justify bonds. 11 Redistricting Yes. Currently, the legislature is in charge of its own redistricting process, resulting in 99% of them getting re-elected. This initiative opens up redistricting so it is no longer controlled only by the party in power, and I like that. There are some flaws in the proposition, but I feel it will be an improvement over the current system.

Actually, I was just talking about that case with my dad, saying I was looking forward to the outcome of his appeals, because were I a juror, based solely on what I heard through the media (I was not able to watch the whole trial nor read the transcript, so my information is incomplete), I probably would have found him not guilty, as I felt there was reasonable doubt. You don't see our entire lives, Lucky. I haven't been a law student for a while now. When did you pass the bar? Have you read DC v. Heller? Miller addresses the type of guns one may keep, and Heller addresses who may keep and bear them. Heller defines the second amendment as a right that is exercised individually that belongs to all Americans. The case went on to define "keep arms" as "a common way of referring to possessing arms, for militiamen and everyone else". (emphasis the court's, not mine). The court defined "bear" as "at the time of the founding, bear meant, as now, to carry...when used with 'arms' however, the term has a meaning that refers to carrying for a particular purpose - confrontation." and went on to say that "it in no way connotes participation with a structured military organization." And, it is in Heller, that the Supreme Court provides you with your definition of "well regulated." You can find it on page 26 of the court's opinion if you wish to check. "Finally, the adjective 'well-regulated' implies nothing more than the imposition of proper discipline and training." Yes. See Heller, above. The majority opinion was written by Scalia and joined by Roberts, Kennedy, Thomas, and Alito. That would be five.
  6. Lucky, look back at the history behind that amendment. One of the original drafts said: "A well regulated militia, composed of the body of the people, being the best security of a free state, the right of the people to keep and bear arms, shall not be infringed, but no one religiously scrupulous of bearing arms shall be compelled to render military service in person." (Journal of the Senate of the United States of America, Volume 1: p. 63) If the second amendment was not an individual right, the militia would not be the body of the people (everyone!). Look at the way the words are used in other examples from the time. For example, take a look at Virginia's Bill of Rights (1776): "That a well-regulated militia, composed of the body of the people, trained to arms, is the proper, natural, and safe defense of a free state...” That example defines "well regulated militia" as "the body of the people, trained to arms". "Well regulated" was a very common term at the time, and would therefore not require any specific definition itself, anymore than we would think to define everyday language we use today. It just meant well trained, that the individuals with the weapons would keep them in good repair, know how to use them, and have a basic understanding of tactics.

You did what you could to be there for him. Harry was important to so many people here and he was my friend, and I'm grateful that he had someone there trying to look out for him.   8. Damn, Harry, I'm gonna miss you. You have been such a good friend to me over the past year, always full of fun and kicking my ass to get back in the air. Thanks for the day at Catalina, teaching me to skip stones at Lake McScottish, and most of all, just for always being there with a hug and a shoulder whenever I needed one, and I'm sorry I never told you how very much I appreciated your friendship.   9. It does, but it only needs to run once a day, not every time your cat uses it, so CatGenie recommends running it during a time when your cat tends to be sleeping. That's what I did with mine at first, and after a while, he just ignored it when it started its wash cycle.
  10. Mine's in the kitchen. I got a small cabinet from Ikea and put a www.cathole.com in one end and drilled a hole in the other end for the water and drain line to exit, and connected them under my kitchen sink. My mistake was allowing my father to do the plumbing. Three floods and twelve pieces of pipe later, it works fine.
  11. As long as you run it often enough for how many cats you have. I have mine set to start running 30 minutes before I get home from work, so no matter what fuzzbutt has done in the box during the day, my house doesn't smell like catbox when I get home. Mine runs once per day, but I've got the cat on really high quality cat food (less poop and less stink) and I've only got one cat. If he does something really stinky on the weekend, I just walk over and hit the extra cycle button.

  13. I do consider my pets as part of my family, however, I don't treat them as children and I don't take them everywhere. Treating them as part of my family means: 1. They are loved and treated with respect 2. Their needs come before my wants

  15. That's fucking awesome!!! How long have you had it? I've had a cat genie for almost two years now and love it. Their customer service is amazing too. They've never once charged me for anything, even when I've been a dumbass and broken something when it's been my fault and totally out of warranty. "Hi, Catgenie. I need a longer water hose." "No problem! We'll send one right out! How long?" "Ten feet?" "Okay. You should have it in a couple days." "What's it going to cost?" "No charge!" "Hi, Catgenie. I was a moron and dropped the motor and snapped off the little nozzle on the bottom when I was cleaning it. Is this going to be a problem or is it okay?" "It'll probably be okay, but it might make the solution get used up a little faster than usual. Let me send you out a new motor unit just in case. You should have it in a few days" "uh oh. It's out of warranty. What's that gonna cost?" "No charge!" "Hi, Catgenie. I was a moron and stepped on the plastic gear when I was giving the catgenie it's yearly scrubbing and the cat tripped me. The warranty expired six months ago, and I need a new gear. What's it gonna cost?" "No charge! You'll have it in a few days!" CatGenie rocks!

  18. I get them every year. I started getting flu shots in law school because I could not afford to get the flu during finals and lose and entire semester, because if you miss a final, you fail, and there's no excuses unless you're in the hospital or a family member has died and you can produce the death certificate. Now I get flu shots because my grandparents have been having some medical problems and I spend a lot of time with them, and I don't want to get them sick if I catch the flu and pass it along before I know I'm sick.
  19. They have to, since the federal government is in charge of other laws, such as immigration or tax laws which treat married people differently. Thus they have to deal with definition of what "married" is. Yes, but I don't think the law should treat married people differently. Discrimination on the basis of family status is still discrimination.
  20. Get him checked for a UTI. Make sure there is no medical issue before exploring other options. Dogs pee for a couple of reasons. It may also be a dominance thing. Are you doing the proper things to be a leader for your dog? Have you done anything to upset his routine or cause him stress? Is there anything new in his environment?
  21. I don't see why the federal government should be in the business of legitimizing religious and social relationships between individuals at all, but if it is, it should not place restrictions on whose relationships can be legitimized.
