Mr. McCAIN (for himself, Mr. Cornyn, Mr. Cotton, Mr. Sessions, Mr. Burr, and Mr. Graham) submitted an amendment intended to be proposed to amendment SA 4979 proposed by Mr. McConnell (for Mr. Inhofe (for himself and Mrs. Boxer)) to the bill S. 2848, to provide for the conservation and development of water and related resources, to authorize the Secretary of the Army to construct various projects for improvements to rivers and harbors of the United States, and for other purposes; which was ordered to lie on the table; as follows: At the end of title VIII, add the following: SEC. 80__. COUNTERINTELLIGENCE ACCESS TO TELEPHONE TOLL AND TRANSACTIONAL RECORDS. Section 2709 of title 18, United States Code, is amended by striking subsection (b) and inserting the following: [[Page S5512]] ``(b) Required Certification.-- ``(1) In general.--The Director of the Federal Bureau of Investigation, or his or her designee in a position not lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge in a Bureau field office designated by the Director, may, using a term that specifically identifies a person, entity, telephone number, or account as the basis for a request, request information and records described in paragraph (2) of a person or entity, but not the contents of an electronic communication, if the Director (or his or her designee) certifies in writing to the wire or electronic communication service provider to which the request is made that the information and records sought are relevant to an authorized investigation to protect against international terrorism or clandestine intelligence activities, provided that such an investigation of a United States person is not conducted solely on the basis of activities protected by the first amendment to the Constitution of the United States. ``(2) Obtainable types of information and records.--The information and records described in this paragraph are the following: ``(A) Name, physical address, e-mail address, telephone number, instrument number, and other similar account identifying information. ``(B) Account number, login history, length of service (including start date), types of service, and means and sources of payment for service (including any card or bank account information). ``(C) Local and long distance toll billing records. ``(D) Internet Protocol (commonly known as `IP') address or other network address, including any temporarily assigned IP or network address, communication addressing, routing, or transmission information, including any network address translation information (but excluding cell tower information), and session times and durations for an electronic communication.''.   4. America had less to do with wining WWII than what most American's think we did. The Third Reich had basically figured out around '42 that invading England was not going to be successful due to the amount of resources it was going to take for a full invasion and occupying force. Once they opened up the Eastern front they basically had committed themselves to no longer landing on British soil and instead were going to just continue to bomb until England agreed to leave Fortress Europe alone so they could then focus on just the Eastern front. The Russians are the ones that once they got drawn in in June of '41 via Operation Barbarossa that really started to hinder the German war effort. By the time the US landed at D-Day in June of '44 the Russians had killed over 2million Germans, destroyed tens of thousands of pieces of armor and had suffered losses of over 5 million troops and around 4 million civilians. They had stopped the Eastern advance in the fall of '42 and tied the Axis forces up in Leningrad for 2 years while sapping their manpower and supplies despite suffering massive losses. US Involvement on the Western front was massive in terms of removing the occupying forces but if you just look at the raw numbers of causalities its clear that the US involvement was not near as large as a lot of other countries. US total causalities via both Europe and the Pacific have been cited at around 419,000. Russia lost 8-11 million soldiers, UK was 380k, France was 210k, Yugoslavia was 350k, China had 3-4 million soldiers also killed in the Pacific.   5. The other thing that needs to be considered is that you can be "rated" on paper only without sending the paperwork in right away. I forget the time limit but there is a 30 or 60 day window that allows for the paperwork to be sent in and processed before the UPSA sends you back your official card. TE's could be holding the paperwork before sending it in but students think that they are fully rated and go off with a paper rating to work at a DZ somewhere. Other issue is that per the USPA guidelines RD's are allowed to make field level actions of revoking ratings or memberships but these need full board approval to be longer than I think 60 days. USPA only holds 2 full board meetings a year for disciplinary actions in person and everything else has to be done electronically or via special procedures. Look at the summary of the winter meeting note and you see they had notes on people for the last 6 months in there including a few cases where they suspended a rating or membership but then said it took effect weeks earlier than when they approved it. Side issue that I thought of on this is that TI and TE's have to have a current class 3 medical via the FAA right now. This is going to be a lot of speculation from this point forward - If this is the same person that was mentioned in another thread that had an arrest for methamphetamine possession and intent to distribute on April 2 2014 then that would have needed to be reported to the FAA at that time and that would have resulted in an instant suspension of his medical on that date. There is a process that the FAA uses in cases like these that the medical is suspended until proof of a completed treatment program and other things but that is a long process. Most times issues like DUI's, new medication and health concerns are identified at the renewal of the certificate every 60 months if you are under 40 years old or every 24 months if older than 40. In between the renewal it would be up to the medical holder to self report and if they are found not to have done that it is grounds for non-renewal. FAA's site shows that a medical was issued in 2011 for a Robert Allen Pooley so if he is under 40 he would not have to renew it until this year. This complicates things a lot since his medical might\should\could have been suspended via the FAA starting in April of 2014 at the time of arrest and therefore he was ineligible to use the privileges of it including tandem jumps and instruction moving forward. Technically all courses ran from the point his medical should have been suspended were really invalid since he was not under a valid medical and therefore none of his ratings were really valid. If he kept running courses all the way up to the USPA\UPT suspended his rating all those courses would need to be invalidated some how. Just going further out there that his employer at a DZ should have known about an arrest for drug possession\intent to distribute and that it would render his medical invalid starting at that point. USPA Professional from last week: USPA Acts to Ensure Proper Tandem Instructor Certification A recent fatal tandem accident and subsequent information have led USPA to conclude that a number of candidates who attended tandem instructor rating courses at The Parachute Center in Lodi, California, and other locations conducted by either Rob Pooley, #155136, or Yuri Garmashov, #163264, were not properly taught and/or were not properly certified. Some courses may have been abbreviated or incomplete, or candidates may not have met initial qualifications. Post-course rating applications may have been submitted under false pretenses or with forged signatures since, in some cases, the course examiner had been suspended and was not authorized to conduct courses. In the interest of public safety, USPA is taking steps to ensure that all of approximately 140 tandem instructors and candidates affected can demonstrate proper emergency procedures, have completed the knowledge tests from USPA and tandem manufacturer United Parachute Technologies and have submitted proper rating applications to both UPT and USPA. About 120 must undergo a new USPA-developed refresher course (some immediately and most by September 30), while some 20 others have had their ratings suspended and must undergo a full and complete tandem instructor rating course conducted by a current USPA Tandem Examiner. Here is USPA's announcement explaining which requirements apply to which tandem instructors and candidates. Meanwhile, Rob Pooley and Bill Dause, #330, have had their USPA memberships and all USPA ratings suspended pending completion of an investigation. USPA Tandem Examiners USPA has emailed all current tandem examiners with details of the recent action. Examiners were also provided the content of the new USPA-developed refresher course that many of the affected tandem instructors/candidates will need to undergo. The refresher focuses on ensuring that all affected tandem instructors/candidates receive a review and practical training on tandem emergency procedures and demonstrate required knowledge by completing both UPT's and USPA's written tests. In addition, examiners will ensure that the tandem instructors/candidates meet all of the USPA and FAA requirements for tandem instructor ratings. Here is information USPA is providing to current tandem examiners, with details about the new refresher course. Information for DZOs DZOs should be proactive in checking the credentials of your tandem instructors, since some number of these individuals have been conducting tandem jumps without any rating whatsoever. Some are not even USPA members. USPA's Basic Safety Requirements (2-1.F.4.c.1) state that any USPA member who conducts tandem jumps must have been certified by the appropriate parachute manufacturer as being properly trained on the use of the specific tandem parachute system to be used and must hold a current USPA Tandem Instructor rating (meaning they must be current members). Among other requirements, Federal Aviation Regulations (105.45) require that any person who conducts tandem jumps hold a master parachute license issued by an organization recognized by the FAA; has completed a course given by the manufacturer or a course acceptable to the FAA; and has been certified by the manufacturer or tandem course provider. Apart from manufacturers, USPA is the only organization recognized by the FAA as a tandem course provider, and USPA's D license is the only master parachute license recognized by the FAA. Thus, to meet the FARs, every tandem instructor must have been certified by the manufacturer of the tandem system they are using or by USPA, and they must hold a current USPA D license. (USPA licenses are only current if membership is current.) USPA's Group Member pledge requires DZs to comply with the BSRs and applicable FARs. The pledge also specifically requires that DZs use current USPA rating holders. After September 30, any affected tandem candidate or instructor who has not completed the appropriate process will be suspended (or continue to be suspended) from conducting tandem jumps. I see dates going back to 2011 but those look like they need to attend the refresher so maybe the thought is inadequacy in the teaching all the way back to then? Yuri's dates are from 2014 forward so I have no clue what is going on there since it does not mention his ratings were suspended at that time. With the mentioning of the forged signatures and other paperwork issues they may have wiped the slate clean and tossed all the ratings in the trash if there was questions about the validity of the ratings that either of the IE's were involved in. It sucks for the students that took the classes and it opens the possibility of the students having civil claims against both people for selling a bad bill of goods to them.     Line twists on reserve

    Jumper experienced spinning line twists on his main and cutaway. During this deployment he was unstable and developed approx 7-8 line twists on the reserve. Video shows the jumper slowly attempting to kick out of the line twists with little success while

  18. Jumper was holding a hand held freefly tube that entangled with his main canopy on opening. He was unable to cleanly get rig of this entanglement and his opening reserve was caught in this entanglement also.

  23. Jumper was coming back from a lay off from the sport and ended up making a low turn on his toggles on a no wind day and hard a very hard landing. He suffered fatal injuries from this landing.
