Alright, which one of you fuckers called that feral tomcat and told him to stay away last night??? The only thing that showed last night was a small skunk, hardly the thing I was in the mood for shooting. And to those who want me to call animal control, had you read the original post, we're in the freakin country. There IS no "animal control." The hunt continues today. I miss Lee. And JP. And Chris. I can't think of a U.S. manufacturer who doesn't issue ANY manual with their equipment, but they are all pretty generic, and with the usual disclaimers. For PD, you get one manual (Ram-air Owners Manual), which mainly covers packing, line trim, maintenance, etc., but doesn't refer to specific canopy types. They then do a fantastic job of providing additional guidance by canopy type in additional documents with flight characteristics and comparisons. Brian takes this further than most others (the BAS manual is almost the Reader's Digest version of "The Parachute and Its Pilot"), but I think that's due more to his personality and commitment to safety than any legal issues. Basically, I guess not having ANY manual would probably be looked at as "gross negligence", which, waiver or not, is a potential legal issue in some states. So that's my best guess.

True, but the risks you assume do NOT have to include the risk that the DZO is deliberately flouting FAA regulations on aircraft maintenance and operations, or pilot qualifications. These are risks that are totally avoidable. Kallend makes a good point. When one signs the waiver, does he or she expressly state that they are promising to not sue if something happens to them, even if it's due to something like what Kallend is suggesting? It reminds me of the Twin Bo crash at Tennessee Skydiving Center in, what was is, 1996 or 97? If I remember correctly, the NTSB faulted Chris Martin over faulty maintenance. (I'm going off of memory here, so forgive me if I'm making a mistake). One of the victims in the crash sued and IIRC, was awarded a nice chunck. Don't know if she got anything, but still... Doesn't this point out what some others have said already, that if negligence can be proven that the waiver really doesn't mean shit? Note to potential flamers: This post does not reflect any personal opinion on the matter of waivers, personal responsibility or love of bowling. I miss Lee. And JP. And Chris. And...

here's a post that I made to someone in another thread that is relevant in this one too (link to original post and thread below) Here's a question that I honestly don't know the answer to regarding the legal issue that you raise... Isn't that a double edged sword? I mean, if there is reluctance to put out an encyclopedic manual for fear of some legal binding that it may have, can't it go the other way? Couldn't a court fault a company for failing in some way for putting out a product w/o also producing an owner's manual? Why would having a manual in any way legally bind a company should an owner/operator screw the pooch when the manufacturer would STILL maintain it's status as an uninsured, waivered entity that accepts NO liability for the consequences of anyone using their product. I find it odd that a little company like Big Air Sportz would take the time to put up such a manual if the potential legal repercussions were so devestating. http://dropzone.com/cgi-bin/forum/gforum.cgi?do=post_view_flat;post=2291934;page=2;sb=post_latest_reply;so=ASC;mh=25; I miss Lee. Pswaaaaah! Yeah - he and I go WAY back. yeah, I BET you do. How we found out about all this was one time some years ago, my mom found out that my dad was, um, wondering, shall we say... and the little hussy girlfriend had kids... so my mother was drowning her sorrows in a slow gin and coke (ee gads) at my sister's place in Phoenix and my brother in law says, hey, you want me to have the woman scared? nothing serious, maybe take the kids for a little joy ride, maybe break the woman's knee, something just to give her the hint to stay away from [my father]? My mom was like, WTF??? It was just so out of the blue, so seemingly random and matter-of-fact for him to say this, yet he was so serious about it! It's been hard to look at him the same ever since. Just wasnt worth it. Made lots of Money... I mean LOTS of money (Each Dancer had to tip me out 10% of whatever they made.. 20 to 40 dancers working each shift.. I was making 2 to 4 times your average dancer). Biggest problem was since they each were paying me.. everyone of them thought I worked just for her. You ever tried to work with 40 different women that each think they are your boss?? No amount of money makes that worthwhile. Did it for 3 years. Never again. Nice! I only lasted 4 months - Had an affair with the managers GF - She was the "lead" dancer. I pretty much never wanted to show up after he found out - good thing he didn't have my address. lol can't make this shit up! lol! I miss Lee. And JP. And Chris. And...
