For those that haven't read the previous thread, I'll summarize quickly. I was having a heated discussion with a coworker, about a work issue, when he went berserk and grabbed my scrubs (this in in a hospital) with both hands. Then he hauled off and was about to clock me. I grabbed his shirt and tie with one hand and held him away from me. Then I grabbed a chair and put it between us, told him to leave (since he was on the door side of the chair). He wouldn't. Anyway, we were both suspended without pay. This was last Thursday. SInce then I have filed a police report. My sister is a Professor of Labor Law. She called my Manager and left a message stating who she was etc. I was called yesterday and told that they would only talk to me, not my lawyer, and I should follow the chain of command. (There is someone between me and the guy she called in the chain of command.) I was asked to come to a meeting with a guy in HR at 2PM today, Eastern TIme, that I never heard of. (I've hardly heard of anyone in HR since I never get in trouble) I don't know if I scared them with my lawyer (sister), and they'll just reinstate me, or if they'll just fire me or what. I also have feelers out and will have a real NY lawyer soon, if I need one. (My sister lives in LA, CA.) So, just wish me good luck. BTW, there is Cyrillic writing in the corner of the image. My niece speaks, and reads and writes Russian. I E-mailed for a translation. The name of the file is dva kryla. Dva means two, I believe. In New York City it helps to know a little of almost every language. North

They asked for a statement after the incident. I was still fired up when I made it. Great adrenaline rush. About as good as my last jump. But I digress. Anyway, I was still worked up, and pulled no punches in the statement. I demanded that they fire the guy for assaulting me. It really went further than harassment and bullying. North

I think more because it is such a minor incident are the cops so busy. According to the grapevine, and actually I was aware of it when it happened, this guy was suspended for being nasty to a patient's family member. This certainly happened more than once, but this was the wrong family member to get smart with. As for references, this guys been there maybe ten years, to my more than twenty. I don't think anyone is thinking about references anymore. I do remember several occasions when he would lose his temper when speaking with our supervisor. I remember thinking that our supervisor was really giving him a lot of slack. I already mentioned the numerous times he would fly into a rage with my coworkers. Lately I've been realizing that in reality, our employer has been ignoring the warning signs, letting this guy slide, until he snapped and went apeshit on me. I ignored the warning signs too, but its not my job to worry about him. He doesn't work for me. If HR sweeps this under the rug, I can live with that, I suppose. I really want him fired, but I don't know if they will do that without firing both of us. This is the perfect guy for me to almost have had a brawl with. He must be the smallest guy in the place. I'd say maybe 5'2", or less, about 120 pounds. He does not strike fear into my heart. As far as the witness situation, there is one, and I'm pretty pissed at her. She's claiming she saw nothing, yet she was right there. Unless she went blind and deaf for a few minutes, or lost consciousness, she HAD to see at least something. Now she doesn't really talk to that little shit, because he's so impossible, and we get along fine, so I'm really pissed that she's clamming up. I really could lose my job over this, and she really should know this. Did I mention that I was pissed at her? North

Just to repeat, for those who read only the beginning, and hopefully near the end of the thread, thanks partly to your encouragement, I DID report this a few hours ago. At best it will help cover my ass. I know he won't be arrested, since the cop didn't even want his name. (I don't want that anyway, I really just don't want to lose my job thanks to a maniac.) North

I realized that my police station, which is across the street, might take the report, which they did. Sheesh, was this much ado about nothing. As Skycop said, the officer said it was harassment, not assault. He said the guy wouldn't be arrested. He clearly didn't want to take a report, but I explained why I need it. He listened to me, wrote for about 3 minutes, then gave me a slip of paper and told me to call the 19th precinct, where this happened, for a report number. Then I asked him, "don't you need the name of the other guy?" He thought for a moment and said, "no, since he won't be arrested." I asked him if I could have a copy of the report and he said I'd have to request it separately. This is why I didn't want to do this. This made so little sense it hurt my head. But I do have a piece of paper, with the wrong date on it, the 21st. He did put his name and badge number. I did the best I could. Thanks people. The other guy did get suspended either once or twice for saying the wrong thing to a relative or patient. Lately he's been bursting out in these ranting rages once in a while for no real good reason. Nothing physical before that I know of. This was included in my statement to my employer. North

Well, OK, I think a consensus has developed. And I guess you all are right. I really do hate to do this. The police here sometimes are unfriendly and sometimes are not happy to deal with things that don't seem important to them. But it seems I need to do this. Believe me, I wondered the same thing. But, I didn't know I was gonna get suspended. I thought he was gonna get fired. (Which he still may, God willing) North

Good questions. Yeah, the other guy was suspended too. There was a witness, but she tells me she didn't see anything.

I've mentioned this problem in some other posts, but I just realized that I could ask you guys and girls your opinion. I was suspended yesterday because of an "altercation" at work. I am, or was, a Radiologic Technologist who does CT Scans. There was a dispute about a patient, and whether he should come to the scanner, and about what we should do about Respiratory Precautions, etc. I don't think all that is really relevant anyway. We both were getting angry, etc. He grabbed my scrub top with his hands, a little below shoulder level. Then he let go with one hand, made a fist and was about to land a punch in my face. I grabbed his shirt and tie to hold him away from me. He's significantly smaller than me, and I think my arms are longer and I could keep him from reaching me with his fist. We somehow got disengaged and I grabbed a chair and put it between us. He was on the side with the door and I told him to get out, which he wouldn't do. So, I'm at home, suspended without pay, pending "investigation." Assault: Threat to inflict injury with an apparent ability to do so. Also, any intentional display of force that would give the victim reason to fear or expect immediate bodily harm. One of my questions is whether I should report this to the cops, as it looks to me like this WAS an assault. Battery: A beating, or wrongful physical violence. The actual threat to use force is an "assault;" the use of it is a battery, which usually includes an assault. Since he grabbed my shirt, I think this is also Battery I'm not a lawyer, but I realize that these definitions and the law may vary depending on the jurisdiction. This happened in Manhattan, NYC. Anyway, should I report this to the police? Do you think this would help my position in terms of keeping my job. (I am concerned that the hospital ((New York Presbyterian, Cornell campus)) may have a zero tolerance kind of rule). Do you think this would just make things worse? I don't know why, but I just can't decide if I should do this. I came so close yesterday, I actually walked into the police precinct. But I changed my mind, I would have been late for a physical therapy appointment. (Don't ask). Well, anyone think they have a helpful opinion?
