Yes, they are different. The difference has been explained repeatedly, and this is the last time I'm going to bother. The first baker refused service to a person because of who he was: a gay man. The second service refused service to a person because of the type of service he wanted: offensive language. If the gay man from the first story came in and asked for a big throbbing penis cake, the owner could have refused based on the fact that they don't do sexual cakes. Similarly, if the baker from the second story had refused to make Bible cakes because the customer was a Christian, then they would be wrong. In reality, she clearly stated she had no problem serving a Christian, or making Bible themed cakes, but she rightly could refuse to put offensive words on those cakes. If you don't get the difference, I can't help you. - Dan G

An individual's rights end when they infringe on another person's rights. As a public business, and owner does not have the right to refuse service to a class of people. Doing so infringes on their rights. If the baker/pizza guy/photographer doesn't want to interact with the public (all of the public) as a public business, they he doesn't have to. Once they open their doors to the public, they have to treat everyone equally. - Dan G

I'm guessing (and only guessing) that the FAA medical is a requirement because USPA doesn't have the resources to manage their own medical certification process. It also makes sense, since TI's like to call themselves pilots in command, that they have the same medical fitness as airplane pilots in command. Heck, I think a really good argument could be made that a Class 2 is more appropriate, since TI's are engaging in commercial flight for hire. - Dan G -

I have a third class medical as a pilot. I'm not a TI, nor ever was. I agree it's pretty basic, so if you can't pass it should you really be responsible for a student's life? - Dan G -

The FAA medical is about a lot more than DUI convictions. The discussion has become focused on DUI convictions, but I think the FAA medical has value in catching a lot of medical issues, DUI being only a single item. - Dan G -

Or due to the fact that there are currently no (or very few) TI's who have DUI convictions. I mean, there are no documented cases of a TI with only 50 jumps and a B license causing an accident, so obviously people with 50 jumps and a B license can safety be a TI. - Dan G -

But then the risk should be compared with one five minute jog, or one boxing round, or one lap in a race car, not a lifetime of jogging, or a pro boxing or racing career. Skydiving is dangerous. Why would anyone think otherwise? - Dan G
