  5. I realize I did not have all the facts. I was just trying to consider if there were mitigating factors Hard to define, and even harder to prove. Again if an annoying behavior pattern has existed before any running fued then they are merely being annoying. If however they have deliberately targetted their behavior to interfere with his peace of mind then it would qualify as harrassment. Agreed. I interpretted it as harrassment. People who feel stalked and harrased do react in all kinds of ways, That is why we have created such awareness of it in our society. Again I do not condone what he did, and agree that he deserves to be punished. I do however feel that if there was a pattern of harrassment over time it could affect his mental state and that could be factored in during sentencing If behaviour is being conducted deliberately to interfere with your peace and enjoyment in your own home, then it fundementally is the same thing. Otherwise harrassing phone calls would be legal. I do not condone shooting people for being annoying, I am merely saying that there could have been more to the story than the usual neighbor dispute over annoying conduct. Again I really do not know the whole story, so I cannot say for sure.   6. Wow. I am sorry you are having such severe problems with your neighbor. It sounds like you might however be misreading him. There is a good book called "Don't Sweat the Small Stuff" which helps prevent lifes minor irritants from taking on a life of their own. In particular you might want to read the section called "See the Innocence" which describes how a person may appear to want to annoy you yet actually doesn't intend to. If you are seriously considering killing your neighbor over this, you might want to consider anger management (no shame in asking for help). I doubt that a mere dispute of the nature you have described requires such a drastic response. Reconsider before flying off (In fairness I wasn't there so I don't know the situation between you and him). Anyway, hope things work out between you and your neighbor. If you need any advice I am always available, particularly if you just need to vent. Do however consider counselling though because you may regrett overreacting.   7. No, he is merely trying to improve his property and you have a simple dispute which you can take to the city council. In the other case there was a deliberate pattern of harrassment so parking in front of his house (instead of their own) could be seen as harrassment. I am not saying that what he did was right by any means. I am merely saying that we need to hear his side before we label him a wingnut (I presume you want to give him due process). If there was a pattern of harrassment and intimidation, and a jury finds that they where deliberately harrassing him on the night in question then thay could take that into account when deciding whether they want to convict him of murder or a lesser charge. I always advocate walking away from violence but if you are being harrassed in your own home (I don't know if that is the case, it will take a jury to decide that) and threatened,it can take a terrible psychological toll on a person as there is no-where to walk away to. I am just saying the mans side of the story should be heard before we declare him a psycho. I have dealt with stalking victims before and have seen how much stalkers can psychologically wear a person down. Again neither you or I know the whole story so I feel we should let the jury decide on this one.   8. Killing three people for drinking beer and playing loud music just doesn't cut it with me. It was more than just loud music. There had been a pattern of harrasment. Parking deliberately in front of a guys house with the intention bothering him in his home is a deliberate attempt at intimidation. It is regrettable that people died but thugs need to learn they cannot stalk and terrorize people for their own amusement indefinately without eventually causing a violent response. It is fine to say that harrasment/stalking is illegal but it is so hard to prove. Furthermore having dealt with stalking and harrassing/intimidating behavior I can say from experience that the cops will take your report, file it and do nothing untill after something happens to you or the stalker. This man may very well have been at his wits end. It is one thing for a thug to intimidate and harrass me when I go to a bar because I can always find another bar. If a man is constantly feeling threatened and harrassed in his own home he has no repreive and will eventually snap.   11. I would think the opposite would be true. If he had a lack of courage under fire it would have shown up much earlier. In fairness I do not speak from experience but I would imagine that such units are very rigorous in their psychological scrutiny of applicants. Furthermore according to the article he has already done several high risk missions so why now would he suddenly become afraid? Ethical conflict seems more likely Your military is made up of human beings and therefore subject to the same shortcomings as the rest of the human race. No-one has said that everyone over there is doing that. Perhaps it is only the guys in the specific US unit he is working with (again I really don't know). While I will not give immediate credibility to his statements you cannot just say that they cannot possibly be true.   13. Not enough info to make a solid assessment yet. If it was just that he was getting pissed off then he was wrong. That said a 66 year old man can be easily intimidated by a teenager, and if the teenager had been deliberatelly making a point of entering his property for the purposes of harrassing and intimidating him then the old guys actions may be mitigated. Most of us I presume are still young and fit enough that the average teenager cannot intimidate us, but at 66 you will in most cases be significantly depleted physically and therefore an easy target for bullies who take cruel pleasure at tormenting the weak. If you are subject to intimidation every day on your own propertyyou might eventually snap, in which case a jury may have sympathy on the man. Again this is all speculation and the guy may just be a contankerous old bastard who lost his temper.   14. I really don't like either extreme, although I jump all year long. I think the coldest jump I've made it was 21 degrees on the ground. My fingers just didn't want to work at all... painful On my very first winter jump I was terrified that my fingers would be too frozen to, deploy my pilot chute. Perhaps may seem illogical now, but at the time, it was a real concern. Regardless of how he reacted to the situation, he was in violation of the law, the minute he entered the store (unless he went in there to stop an attack in progress) If you are attacked and there is an illegal weapon (not yours) within reach you are allowed to use it. If you are carrying one illegally, then you will not be charged for using it in self defence but you will be charged for having it on you in the first place. I agree with you in spirit but technically the charge is valid. Shame though because I love hearing about violent thugs getting lead poisoning.   23. I am not suggesting that someone has to go kung-fu on someone. As Nightingale pointed out, merely having an adult saying "excuse me, what is going on here" will in often send a would be abductor packing. If he continues taking the child and you feel that would destroy you in a physical confrontation, then follow at a safe distance and start yelling yourself to get passersby to help, and get on your cellphone and dial 911. Just don't stand there and do nothing. The child being abducted could be raped, tortured and killed. Do what you reasonably can if you are not willing to risk physically intervening. Not blaming them for the abduction. Merely being furious that your child may now be dead and this person was there when he/she was abducted and might have been able to merely scare the person off just by speaking up but chose not to because he/she would rather not get involved. It's for that reason people don't want to get involved. I HAVE become involved in situations similar to what was used as the original example. I've broken up fights between kids in a mall, and I've pulled a kid out of the street infront of oncoming traffic. Were any of those things my responsibility? Would I have been remiss for not becoming involved*** With regards to the kids in the mall, sometimes it is best to let kids learn the hard way (provided it is not several kids against one, or a big kid against a small one).
