As for Sharky, he and I are friends from when I started skydiving. He was there when I got my license - you know, that piece of paper which allows me to jump by myself? You get it after you go through AFF...have you started yours yet? Shark was with me when we did a 7 point 3 way. You know - when you and two friends go skydiving together and switch grips and stuff before you put the canopy out? And no, grabbing your tandem master's hand seven times does not count...   9. Actually, I didn't read the whole thing. Just the first post. And laughed...and actually, thank you for recognizing my "exquisite intellectual taste"...I'm pleased it shows so clearly. Watching repeats of Love Boat, nawp...an hour sitcom with canned laughter is something I grew out of a very long time ago. As to being home on a Friday, I notice that you are, as well.   17. Sorry I didn't do better before, but here is an admittedly lame attempt at setting out some thoughts about a ground class... May 30 post How about starting somewhere, and developing something which will work from there? A video is a good idea...and there already are several. But you don't learn from watching a vid...you learn from doing. Can a vid be incorporated into the above ideas? Absolutely. However, there needs to be more "doing", I think, as well as "watching". So incorporate the vid into a ground class, and set out a series of manuvers which are mandatory to be able to demonstrate prior to getting your "A" license? There would be several advantages to making it "mandatory", and that is: 1. Removes the peer pressure from it (hey, I gotta do it before I get my license) 2. Teaches the person before they are generally financially able to purchase gear which gear would be more appropriate to their level. 3. Allows a mentor relationship to begin. Ask Skyslut about Skydive New England's procedures. They seem to be doing something along the order of what I am talking about, and it seems to answer some of the questions. If it works for them, why not take the basics from there and expand it outward, make it "standard", and encourage all DZ's to use them?   19. So why didn't you go talk to her? Or did you talk to her, and she didn't listen? Or did I miss you saying it was your student and you had already talked to her? As someone who's had a malfunction during student jumps, it did take me a while to identify, assess, and decide (my version of IAD). I opened at 5.5, and was under my reserve and checking alti at just under 3. Because of that, and because I have low jump numbers, I want to pull higher because I want that time to decide is this a mal I should cut from or not? An extra 5 seconds or so to make that decision is not an issue, and I pull regularly at 4-4.5. Does this mean I can do big ways? NO....then again, I am not ready to do them, either. Further, I like the time under canopy. There is so much to learn about how a canopy behaves and more specifically how my canopy behaves that the more time I spend under it the better.   25. What defines reckless? A conscious disregard for another's life? Then yes, under that definition. Blowing a .09 at the hospital, given 2 hours to board the plane, have the accident, and be transported, stabilized and so forth, would indicate a higher level of intoxication at the time of the accident (there are charts available to determine forensic intoxication, I believe, aren't there? That doesn't take into account a BMR, but it's general). Under the theory in the law about drunk driving, blowing a .08 is considered drunk (here in CA). Therefore, at the time of the incident, there was a higher level of alcohol present in Cole's system...and he was indeed flying under the influence of alcohol. If he was aware he would be checked somehow, and feared getting taken off the load, and brushed his teeth (or chewed gum or used a mouthwash) with the intent to conceal evidence, that would show a conscious disregard for his and others' safety. California Penal Code CPC 192 lays out the parameters for manslaughter, which states: 192. Manslaughter is the unlawful killing of a human being without malice. (a) Voluntary--upon a sudden quarrel or heat of passion. (b) Involuntary--in the commission of an unlawful act, not amounting to felony; or in the commission of a lawful act which might produce death, in an unlawful manner, or without due caution and circumspection"... So then the question would revert to is "does the alcohol content constitute a felonious level?" I cannot find any specific parameters to use, but anecdotal evidence would lead me to think that a felony would be based on the alcohol content and either a) bodily injury or death, or b) property damage exceeding $500. If I am right in that, the finding of a felony level charge would be accurate. If that is the case, involuntary manslaughter is not the correct charge. As there is no evidence of a sudden quarrel or heat of passion, I don't think this would be a valid charge, either. However, in looking at the parameters of murder, one of the requirements must be malice. CPC 188 states "188. Such malice may be express or implied. It is express when there is manifested a deliberate intention unlawfully to take away the life of a fellow creature. It is implied, when no considerable provocation appears, or when the circumstances attending the killing show an abandoned and malignant heart. When it is shown that the killing resulted from the intentional doing of an act with express or implied malice as defined above, no other mental state need be shown to establish the mental state of malice aforethought. Neither an awareness of the obligation to act within the general body of laws regulating society nor acting despite such awareness is included within the definition of malice." If the killing can be shown as a direct result of jumping with an abandoned and malignant heart, because Cole took steps to conceal his intoxication level knowing that his actions would a)ground him and b) were illegal, one can then argue that there is indeed implied malice present. As I see it, the incident could be shown as a direct result of his intoxication, because the parameters given are such that there was no previous injury. I couldn't find anything about murder 2, which is what I think this would likely fall under. Keep in mind I am not a lawyer, and could be full of beans...and may have missed something vital in either the original question or in the CPC.
