Fortunately, we have judicial review to keep Congress in check. Pardon me, but you are sadly mistaken. The suit I referenced above is petitioning the Court/Judiciary to review said-Agency's actions (via the authorization of Act of Congress - Section 302 of the 1996 “IIRIRA”) against me, to which that Agency's response via the DOJ is that they are NOT subject to judicial review. Thus far, we are still awaiting a hearing/ruling on the action filed back with the District Court in December past. I'd rather be spending the money on jump-tickets and scotch in Eloy. That is one opinion, yes. When you live next door to the biggest kid in the schoolyard, life tends to be different. Hasn't seemed to work out quite so well for the citizens of Mexico though. Elaborate please TK. In my experience, (not personally, just through associates), when a Canadian lived permanently outside the country, they did not declare or file in Canada. Only if/when they returned for residency and began paying Canadian taxes, they filed a simple one-time document indicating the the time they were out-of-country. That was the extent of it. A friend of mine holds triple-citizenship: UK, NZ and CDN. He currently works independently in both NZ & Canada. He files his NZ income in NZ with no requirement to disclose his CDN income. He files in Canada his domestic income, also with no mention of his NZ earnings. In my wife's case, she came to Canada when she was 15 years old. Has never worked a day in the US. Unlike Canada, the US assigns SSN's at birth, so she has one (long since misplaced). The only returns by her to the USA for 40 years is to visit family for weddings, Christmas, etc. Her situation is far from unique up here as you are no doubt aware. As such, it is surprising the IRS feels they are "owed" anything by her. Hell, I told her to just tell them to go screw themselves. But, that's just me and how I react to bullies. No. Canada still recognizes the reciprocity agreement for taxation. That, according to my accountant. ETA: Canada also allows you to work off-shore without ANY tax liability for those specific earnings, provided you live outside the country for more than (est) 185 days annually. A significant reason so many Canadians in the gas/oil industries work large-dollar contract-jobs in the North Sea and the Middle East.
