I guess we need Andy9o8 to weigh in here. When I worked in the field, the courts would order AA/NA for a certain length of time and the meetings had to be documented for the probation officer. If the individual was arrested on the same charge a 28 day program plus AA/NA was usual. Another offense would get you a 90 day outpatient or sometimes inpatient plus AA/NA upon discharge. If the client was arrested again usually it was usually jail time because 6 month programs are scarce. With good lawyer and a sympathetic judge you might get Teen Challenge or another Christian program for one year. In all my years in the field I never heard of the ACLU interfering. In all the substance abuse/addiction treatment programs where I worked, the object was to separate the abuser/addict from his environment and into a period of sobriety. During that time we acquainted him with the AA/NA programs so that they would have the ongoing follow up of a support group post treatment. To that end we had them work an extensive First Step. I always maintained that we needed to have substance use disorder classified as a disease in order to receive third party payments. Court ordered treatment, the type I worked, required paid professionals to document the treatment. Thus satisfying the court requirement. Without documented successful completion of a program the only other alternative is incarceration. And, incarceration does little to nothing for rehabilitating the abuser/addict. The last program I worked incorporated Cognitive Behavioral Therapy as part of the treatment regimen. The main difference, I see, in substance abuse/addiction to other diseases is the psychological desire to pursue euphoria over all other personal, family or social requirements.
