Courteney, Please go back and reread the thread, I know it is alot to read, but it was not an intentional cutaway where a second reserve would be need.like for a stunt as you have implyed. She had no choice but to "punch the reserve" she was running out of alt. The BSR state that jumpers need to preplan a hard deck, and at 1000' stop trying to cutaway, or stop trying to fix a mal, and pull the reserve regardless. OK -

Thank you for your views. The consensus I got was most, or all of you guys wouldn't sue. I don't plan on suing either. This incident happened months ago, If I wanted to sue I would have already filed litigation, and would never jeopardize it by posting it on DZ.com. But that is not the case I simply wanted to here/read your views on this matter. I gave a few details on the matter, you know... medical bill, and wife. I could have posted it under hypothetical heading, and not included details. So let everyone relax -

There is no "contradiction," weegirl.... after evaluating/re-evaluating/and listening to everyones' feedback... That's how I "made my mind up" as to not sue. There's nothing to sue over, from what I gathered. That is no dis-service to you, or others, b/c there is nothing to "leaglly sue over." Repeat: after evaluating info I already had, re-evaluating what I know and what others have VERY RECENTLY advised me, and lastly by the answers I received in this post, there is nothing to sue over. Have peace of mind. Thank you I'm sorry if my post was misleading or not as clear as I had intended. -

Well then I guess you lose your bet... I gave a little info about what happened as an intro to my question on wherther or not "you" ( other jumpers ) would sue. I have read and taken in everything that everyone has written... learning that most would NOT. For the record... I know everything that happened for the most part, with just a few questions, but choose to be vague in my post. (since the real question was about the skydivers' views on sueing...) Maybe I should've just released a poll, maybe it's already been polled... But regurdless I started this Discussion and now I am ending it. Once again thank you for all your OPINIONS and feedback.... I did listen and I do appreciate it! Blue Skies... -

I'm not trying to get rich, Kris. But IF the manufacture is at fault I want to altert the community to the problem, and cover our medical bills that is all. I have been in the sport for almost 10 years and am an Instructor.I have lost many friend, and have gained many new ones. The question I posted has not been answered by anyone yet. Should or Would you Sue? WB -

Was not a premature release. She ment to cutaway. I do not plan to release the manufacture of her gear. But it is a fairly new company. -

Payback 462, Her perticular tsod lable in inside her reserve flap with her reserve packing card, Not a Large Orange lable on the "belly " of the rig like others wrote about. That is all. I did not mean that she was jumping a :non tsod rig. Sorry it taking long for replys I have a lot to answer. I appricate yor cander but let keep it reasonable, please -

NO, it wasn't a unstable deployment, it was a partial release of the main the right side remainded attached, and just for the record she went in with ALL handles pulled, as a matter of fact, she through the reserve handle, after pulling it cause it could cause an entanglment. or so we have herd. -

She could not use her hook knoif scence her fingures were entangled/ traped in her main suspension lines to her right leg. -

Thanks, I call a line twist, or slider up, or a released brake line, or a pilot chute under a contrived mal. Scence it occured during deployment. Sorry for the confussion. It was new gear. -

My wife had a malfunction due to a contrived malfunction, her cutaway system failed, she had to deploy her reserve (alt. remaining) in to her main trash. Survived the spinning entanglment with a broken back. Do you think the manufacture is responsible for poor, or faulty gear. She and I are not newbies, are both Instructors, and current. I feel she did everything right, and saved her life, but the medical bill are adding up, and before I decide to point fingers, I want feedback from the community. Thank you. -

I think Bush did a good job, a good job of ducking the question if he mad a mistake. I think a bigger mistake would be to elect Kerry. If Kerry is elected it will show weakness to our enemies. There may be many Americans who wish to bring our troops home and end the war, but the war will not end just cause most Aericans want it to. The war will end when our enimies are dead. I feel confident that when were are finished in Iraq, we will move on to another country like Iran, or N. Korea. Terrorisim is not going to go away by it self, I can't think of a better leader to fight it. Lets keep the fighting over there in those muslim countries where terror was spawned, and lets keep it peaceful here in our country. If we let our guard down they will get us. Kerry's whole plan is economy, and social security, and other "in house" policies, but what would he do in the face of war, shoot a few tomahawks like Clinton and hope Osama goes away. If we let them blow us up no ecomomy or social sesurity plan will help when were dead. I hope most voter don't join the " band wagon" and vote for Kerry, or give in to peer pressure. I personally don't care what the French, or the rest of the world thinks of us, as long as we have homeland security.

Jason, I remember a while back a buddy bought a black Jav. rig and the only color was pink and yellow pin stripes on the main closing flap. He used a magic marker to color over the colors, he though they were kinda girly looking. At his next repack the rigger said that this was unacceptable, that he had caused damage to the courdura. I don't know personally about this but I would be cautious until I spoke to a rigger about it. -

I'm not 100% sure but I think you have to wear DZ helmet (mostly protec) till you have an A license. Then you can jump what ever type of head gear you want, or none if you so chose. I believe when you rent gear they figure you are not an "up jumper yet" and you wind up with student gear. ie... big canopys, big rig.rsl, aad, large face atl., protec helmet, cheesy goggles. I have heard, and seen Gath as being one of the thinnest helmets, and offering the least "real" protection other than a frap hat, which is nothing more than a ball cap with a chin strap.
