Well, I'm not sure whether "overwhelming evidence" is a higher or lower evidentiary standard than "beyond a reasonable doubt" but the current one doesn't seem high enough to prevent wrongful convictions. ooohhhh 'semantics' yay! (however, perhaps I stated it that way on purpose under the concept that a much higher standard, not just for the criminal, but for the evidence and those conducting the case, needs to apply to even consider DP) I'm seeing a couple things to address: 1 - beta error (kill an innocent) due to sincerely and morally and legally conducted trials 2 - beta error due to shenanigans within the system, (or in false accusations, etc) #1 is a tragedy and really the true discussion here. #2 is a horrible crime that should be wiped out I think that arguing #2 is a tangent to the real discussion which should be centered around #1. But #2 is easy to discuss. (now some want to be absolutist and state beta error = 0. fine, that's a legit position - but then it's void of discussion at all and any old argument can suffice - and i think that's what's happening here - so pointless) ... They certainly aren't willing to compromise on budget issues (especialy revenue) today. that's a good point - or Reagan's deal to add taxes in exchange for spending cuts (was it 2 for 1?), then fool me once 20 years ago as you note, and a few more times since then, an then propose a similar tactic now....... why, who WOULDN'T take that deal???!!!

  7. absolutely great statement - Anti-religious types cry "karma" all the time. Frankly, "Karma" is a crappy religion and I don't see how belief in it is any different. Justice needs to be determined based on specific actions of an individual without bias to irrational beliefs, stereotypes, or other actions. In regards to other actions, they should be judge independently and have their own consequences. their is no natural balance for subjective things in the universe - just actions and reactions ...   11. we have at least 3 MIT grads right here at work that do a very fine job of writing and performing music But I agree about your Julliard grad (certain areas are NOT as friendly to "competence without formal education". Like Science and Technology. Others (liberal arts, etc) aren't so demanding - they are either extremely subjective, or rely on born talent that exists with or without the formal training. though I find Kallend's comment a bit ......... I also find it true, regardless. Very anti-PC....not everyone deserves a medal if they don't put in the homework.) ...   12. actually, he said one thing that was really smart - essentially, that things are different at level lower than the feds, and that the decision needs to be more local than that (yes, I was shocked to here that sentiment from that source). Quade fell down the trap of the assumption that "SOME level of government" needs to control the stupid masses that can't think for themselves. "MY positions are great - everybody should compromise to agree with me" even better - he throws out a few ideas and then conducts about a 95% one sided partisan attack with it. nice example of team playing nothing special, move along Compromise, collaberation - in industry that works because everyone has a common end vision......it doesn't work when the players have multiple visions that are dramatically at odds with each other.   16. Because Americans who support the DP don't want the DP to be about just justice there has to be an element of vengeance to it as well. The offender slipping happily into an unconscious state before death just doesn't cut the mustard. justice is about removing the threat of repeated crimes. not vengeance, not closure, not rehab, not all those other things - DP, incarceration, etc etc etc..... Are you saying that there is a segment that doesn't want drug testing for welfare types because that would reduce the welfare membership numbers? and thus the left would lose some of it's support from those dependent upon government payouts? ...   21. IMHO - do whatever you like on your own time. but if your behavior affects the workplace performance or other employees' performance,,..... Employment should be about performance. Publicly visible employees (entertainment, politics, sport figures, etc) - we might extend the (private) contract to personal life as well. But then the contract should be specific and signed. But that's because 'performance' includes public persona. (I think this extends even past showing up high or drunk, even to people that stink so bad from cigarette smoke that other employees can't work around them.) Then, legalize it all, tax it. AND SERIOUSLY punish abuse of it. And leave alone any that are responsible about it. (IMHO - it's whiny to discuss why liquor is so much more worse or not - we need to just have a standard that applies to both and stick to it) ...   24. same comment - if required for anyone getting taxpayer money, then should apply to all.....or none "start with" and "after" don't make sense if you want all individuals to be equal as far as I'm concerned - the Pres, Congress, execs from companies that get corporate welfare, individuals the get social welfare.......are employees of the tax paying public. They should contractually be required to all have the same employment conditions yes - I'm equating the president, senators and congressment to welfare queens (in terms of who is paying their check) ...   25. both are types of welfare - why would one or the other have to go "first" - just because you have a bias only against one and not the other? both should require some sort of test to make sure that the money and resources they are stealing from others isn't being wasted and abused ...
