McVeigh, a US Army veteran, and American citizen had no help from a foreign entity based overseas or on American soil. No doubt he murdered the innocent but, his primary target was employees of the US Government. On the contrary, trying Jihadists in a civil court is just what islamic jihadists would like. There are billions of dollars in middle eastern banks on American soil available to "indefinitely" defend soldiers of allah. The muslim brotherhood or other "peaceful" muslims have their own lawyers. They would love to use our system against us in lawsuits and delays. People need to understand that Boston was nothing less than the perfect battlefield for killing American taxpayers who fund the US military (children were an added bonus). These terrorists had been groomed by the world jihadist movement whether they received their training on the internet, local mosque or overseas. They thought of themselves as on a mission as soldiers for allah. They performed their primary mission, and were in the process of exploding more ieds when caught. It is unlikely they will be tried by a military tribunal It was 24? hours before the President of the United States had the nerve to use the word terrorist or terrorism. I still believe they gave up any rights under the United States Constitution when they went over to the"other side", the islamic terrorists/jihadists side. I disagree. They are subject to the Uniform Code of Military Justice. Like the German or German American saboteurs, these enemy combatants have the right to a fair and speedy trial by a military tribunal and nothing more. It's hard to visualize that we are at war with world terrorism. Who ever said, "Our military is at war, but American is at the mall" (close) was correct. I would be worrying about the unlimited powers the Department of Homeland Security has on we citizens, and why do they need millions of rounds of ammunition, and armored vehicles. I disagree. Whether they left the country to get radicalized/receive instructions, etc. or whether they got their mission on the internet or at a local mosque, it does not matter. Is there any doubt that their mentors are enemies of this country. Remember the "workplace violence" at Ft. Hood? His mentor was an American citizen in Yemen. Major Hasan is another combatant who should be tried before a military tribunal for terrorism on American soil. The American muslim who killed the young soldier outside the Little Rock Army Recruiting Station is another example. These people do not deserve their day in a civil court. Sometimes the Supreme Court rules shamefully, and they should have been tried in a civilian court? This sounds like the shoulda coulda, but it happened, and it was pushed by that great social humanitarian, Roosevelt. These people came to our country to do us harm during war. No doubt they were "lawered" up, but I can agree with you on one thing: it will happen again, and the quicker the better. We had a lot of success after 9/11 in Afghanistan and othe places so the enemy is changing tactics. Like Neil Diamond sang, "They Are Coming to America", and they should be prevented from using our own legal system against us. We have two open borders, and a State Department that issues student visas to people who fly into our buildings or set off bombs. Now, Islamic terrorists are simply targeting taxpayers (children are an added bonus). Military commissions or tribunals are the answer. They also put the word out that this country means business. During WWII, German American saboteurs were tried by a military commisson courtesty of Franklin Delano Roosevelt. American lawyers attempted to try them in civil court, but the Supreme Court of the United States in Exparte Quinn, upheld the use of military commissions. Eight were sentenced to death including two American Citizens. Ultimately, two escaped death; one being an American, but the rest were executed. There are still places without cell phone service in the US. Hit a deer at 3:00 am that disables your vehicle or have a winter accident and disappear completely out of sight, and you get into a survival situation. All these gadgets were meant to make life easier and safer, but unfortunately, they can become tools by a govenment that wants to control our lives. I'm actually sorry I made that statement, but for different reasons. Back in Feb, I had a guy coming down a hill on a remote logging road slam on his bakes, cross the center line and slam into the car I was driving (wife's Honda Elememt 4x4). He and his passanger and I hiked out for help. Since the Montana State Police was not interested in coming to out to the site (county either), we sent in our statements to the both insurance companies and the State Police in Helena. The kid who totaled his car and mine changed his story in his statement. Even though I had pics showing him plainly on my side, his insurace company would not pay at first, but a month plus later they paid (they finally interviewed the pax riding in the car that hit me). So..., if both cars had the "dark" box onboard, maybe all the threats and worry could have been avoided, his insurance company would have settled early and paid for a rental car. end of story Do your part for global warming: ban beans and hold all popcorn farts.

This is shocking to hear from anyone who's ever taken an American high school civics course, much less an intelligent, educated person such as yourself. Thousands of criminal trials are held in the US every day, and some of them result in Not Guilty verdicts - not because of "technicalities", or "weak evidence", or "bleeding hearts", etc., but because sometimes people who are accused of wrong-doing really are not guilty. If you don't understand that most core principle of any legitimate system of laws, then there's no point to discussing it any further. If that becomes the acceptable standard, then 2 centuries of US veterans have fought, bled and died for nothing. Justice has been served in prior conflicts; justice that you scoff at now because of the liberal bias that has consumed this administration. This selfish president never thought of the innocent civilians or the 200 years of military service you speak of. Have you forgotten, the word "terrorism or terrorist" is not acceptable to him. Govt: Medicare paid $47 billion in suspect claims By HOPE YEN, Associated Press Writer Hope Yen, Associated Press Writer – 1 hr 34 mins ago WASHINGTON – The government paid more than $47 billion in questionable Medicare claims including medical treatment showing little relation to a patient's condition, wasting taxpayer dollars at a rate nearly three times the previous year. Excerpts of a new federal report, obtained by The Associated Press, show a dramatic increase in improper payments in the $440 billion Medicare program that has been cited by government auditors as a high risk for fraud and waste for 20 years. It's not clear whether Medicare fraud is actually worsening. Much of the increase in the last year is attributed to a change in the Health and Human Services Department's methodology that imposes stricter documentation requirements and includes more improper payments — part of a data-collection effort being ordered government-wide by President Barack Obama this coming week to promote "honest budgeting" and accurate statistics. Still, the fiscal 2009 financial report — covering the first few months of the Obama administration — highlights the challenges ahead for a government that is seeking in part to pay for its proposed health care overhaul by cracking down on Medicare fraud. While noting that several new anti-fraud efforts were beginning, the government report makes clear that "aggressive actions" to date aimed at reducing improper payments had yielded little improvement. In recent years, the suspect claims have included Medicare prescriptions from doctors who were dead, and requests for payment for medical supplies such as blood glucose strips for sexual impotence and diabetic shoes for leg amputees. Patients, many of them new citizens who barely speak English, are sometimes recruited by brokers who go door-to-door offering hundreds of dollars for use of their Medicare numbers. Obama is expected to announce new initiatives this coning week to help crack down on Medicare fraud, including a government-wide Web site aimed at providing a fuller account of health care spending and improper payments made by various agencies. The Centers for Medicare and Medicaid Services also will launch a Web interactive next month that will allow users to track Medicare payment information by categories such as state, diagnosis and hospital. According to the report, the Bush administration from 2005-2008 reported improper payments of roughly 4 percent in the fee for service program, or about $17 billion total in 2008. Government officials at the time, however, typically did not consider a Medicare payment improper if the medical documentation was incomplete or a doctor's signature was illegible. Since these were flaws that ordinarily bar payment, that methodology drew complaints from government auditors that the figures were understated. For fiscal year 2009, the Obama administration began counting those claims as improper, but was unable to complete an official tally based on the new methodology. As a result, it officially reported improper payments for its fee for service program at 7.8 percent, representing a partial tally under the new formula. But it considers the unofficial tally of 12.4 percent to be more representative. Beginning next year, the 12.4 percent figure — or a total of $47 billion in improper payments when counting both Medicare fee for service and managed care — will be used as the baseline estimate. The federal report sets a target of reducing improper payments in the fee for service program to 9.5 percent by next year, which would represent a savings of roughly $9.7 billion. The findings come as the Obama administration is making Medicare anti-fraud efforts an important priority. In recent months, HHS has said it was multiplying by 10 the number of agents and prosecutors targeting fraud in Miami, Los Angeles and other strategic cities where tens of billions of dollars are believed to be lost each year. The new partnership seeks to have better sharing of real-time intelligence data on health care fraud patterns. Officials say they also want to increase training and outreach among Medicare providers to reduce documentation errors, while proposed health overhaul legislation would increase background checks on Medicare claimants and impose stiffer penalties for false claims. Other findings: _In the Medicaid program for the poor, roughly $18.1 billion, or 9.6 percent of claims, are believed to be improper payments. _Using a baseline of 12.4 percent in improper payments in the Medicare fee for service program, HHS is setting targets of reducing fraud and waste to 9.5 percent, 8.5 percent, and 8.0 percent, respectively, for fiscal years 2010 through 2012. Records released in the past week showed that CMS for three years ignored internal watchdog warnings about swindlers stealing millions of dollars by scamming several Medicare programs. First of all it's extremely unlikely this will happen. An interesting statistic I heard was that, so far, the conviction rate is 100% for terrorists in the US public court system. Second of all, I applaud the Obama administration for giving these 'people' a fair trial. Regardless of how I feel about these 'people' - everyone, no matter what, deserves a fair trial. Now, when (and hopefully this turns out to be true) - they convict them and sentence them to the chamber, you won't hear a single complaint out of me. Earlier Friday, Attorney General Eric Holder announced that self-proclaimed 9/11 mastermind Khalid Sheikh Mohammed and four other detainees held at the Guantanamo Bay facility in Cuba would be transported onto U.S. soil to face justice in civilian court. "After eight years of delay, those allegedly responsible for that attacks of September the 11th will finally face justice," Holder said. "They will be brought to New York – to New York – to answer for their alleged crimes in a courthouse just blocks away from where the twin towers once stood.” Giuliani, who was mayor of New York City at the time of the attacks, slammed the decision during an appearance on Fox News. “I think this is a very dangerous decision, and an irresponsible one. And one that is absolutely unnecessary. Meaning, if Khalid Sheikh Mohammed couldn't be tried anywhere else but in New York, then of course New York would handle it and do it,” he said. “New York is already a target for terrorists – we announce that every day and talk about it every day. To add something unnecessary to that makes no sense, and the president has made, I believe, an irresponsible decision.” Other Republicans, like Arizona Sens. John McCain and Jon Kyl, and Rep. Peter King of New York, agreed with Giuliani, who said 9/11 “was an act of war. And one of the things I thought we learned from Sept. 11 was that we were in a state of denial before Sept. 11. We went through this once before – 1993. We had people, terrorists, attack the World Trade Center. We did not recognize it as an act of war. We tried them in the Southern District of New York. It did no good. We were attacked in Africa, we were attacked at those embassies in Africa, we were attacked on the USS Cole and then we had the worst attack in our history. “And I hoped and prayed from that day on it would be the last Islamic terrorist attack in our history. And it was not the last, because a week ago we had another Islamic terrorist attack on our soil,” said Giuliani, referring to the shooting spree at Ford Hood, Texas, that left 13 people dead. Nidal Malik Hasan, the Army psychiatrist charged in the attack, reportedly shouted “Allahu akbar!” (Arabic for “God is great!”) as he started shooting. “Why this administration has trouble figuring that out when the man yelled out 'Allahu akbar' when he was murdering people – as a former prosecutor I find frighteningly incompetent,” Giuliani said. ...........................................................................
