  2. I just got off a phone call with the governor's office - I work for the Department of Health. The storm is supposed to make landfall tomorrow between 10 and 2, and I think our Emergency Operations Center had already determined that it is a category 1 hurricane. FSU is still open, though.   9. Yea. It's off-topic, but it's been my personal experience that deterrance reasons for punishing people just don't work. I think we punish people because they've done something wrong, and once they serve their time, they've paid their debt to society. So they've effectively raised themselves back to the level in society they occupied before committing their crime. It's the same reason I think mandatory minimums are crap, and 3-strikes rules are unconstitutional. Anyway, it's not what this thread is about. PM me if you want to discuss it further. I suggest you go read it again, and pay special attention to the part about due process equalling a liberty interest. uh...you're right. I do believe all of those things. And there are good arguments for believing the way I do. Just because I disagree with you doesn't make me wrong or stupid. I'm done here.   12. I'm sorry my post seemed condescending. Believe me, no one would accuse you of condescension. I'm not saying (and never have) that anyone needs a degree in law to understand the Constitution. I am, however, saying that people who have advanced degrees in law understand it better than most, because much of the practice of law involves interpreting the Constitution and statutes. I do not have an advanced degree in law yet. The Constitution isn't just a bunch of words that have one meaning for everyone. It's not that simple. If you think it is that simple, and that you understand the Constitution as well or better than people who have J.D.s and M.M.As then...well...that's a nice little bubble you have there. As for who they defend, the ACLU defends civil liberties. They do that by taking the side of people who have their civil liberties violated. It's not about what these people have done, it's about what the government and other people are doing to them. I know it's a hard concept that civil liberties apply to ANYONE and EVERYONE on US soil, but they do. Even child molestors, abortion activists, and illegal immigrants. If you took a look at the case I posted above, you'll see that the US Supreme Court has ruled that illegal immigrants have substantive due process rights, which takes me to your second question: In Marbury v. Madison, the first chief justice of the US Supreme Court said that for every right, there must be a remedy. Therefore, for every remedy, there must be a right. The case I posted above effectively gave illegal immigrants a remedy for substantive due process violations: they can use our court system to get some sort of justice. The rights for which the remedy exists are liberty interests, because Constitutional scholars have agreed that whenever there is a substantive due process right, there is a liberty interest. Liberty interests are things guaranteed by the Bill of Rights, and those privacy concerns which the Supreme Court has agreed are implicit in the Bill of Rights. Anyway, I'm done explaining the Constitution to you, Trent. If you don't believe everyone in the US deserves the rights guaranteed by it, then it's obvious that we'll never agree. The difference between us is that I agree with the Supreme Court, and that there is no basis in US law at all for your conclusions. Some of us don't agree with the ACLU's founder's remarks. We just see some of the injustices which the government has wrought on today's society, and get involved in ACLU cases which attempt to correct them. That's what I do, anyway.   15. I do a lot of research for the ACLU, and I can assure you that "picking the side that hurts the US the most" is not what they do. They spend most of their time protecting the liberty interests of individuals and groups. Do you know what a liberty interest is? It's all of those things in the Bill of Rights. It's a term of art, used by Constitutional scholars. I realize that you don't think illegal immigrants should be afforded any of these liberty interests, outside basic human rights. Well, get ready to suck it up, cupcake. Zaidyvidas v. Davis guarantees substantive due process to illegal aliens residing in this country. Wherever there is substantive due process, there is a liberty interest. That is, we have to give illegal aliens their day in court or an administrative proceeding (since substantive due process is defined by the courts) wherever we violate their constitutional rights. I realize that you may disagree. But that doesn't make the case law disappear. Take it from me, and my con law professors. Don't like it? Petition for a Constitutional amendment.   18. Actually, I recently worked on an ACLU case. It was Schielder v. National Organization for Women. It was a civil suit. The NOW sued under the Civil RICO act, and lost. Miserably. Want to know why they lost? Because the court decided the abortion clinic protestors had a right to free speech. The ACLU (and I) thought differently because these people were making threats of dismemberment to doctors and patients of the clinic. This type of speech is not protected. The courts in this country have been very clear: the remedy for very unpopular (mean, demented, etc) speech is not to silence the speaker. It's to combat that speech with more speech. Better speech. The kind of speech that is going on here, in these forums. We all know these people are wrong. But that doesn't give us (or anyone) the right to make them shut up.   20. I'll vary my tips depending on whether the masseuse is private or works for a club. For instance, my regular masseuse doesn't work for a club, she just has a little room in a nutritionist's office that she rents. So, because 50 percent of my money isn't going to a club or other facility, I'll tip around 10 percent.   25. I, too, am a beginning freestylist. I have close to 1000 jumps (mostly freefly), and maybe 50-75 of those are freestyle. I mostly just goof around, but I've gotten to the point where I can fly up and dock on my knees. I have found that getting competent at freestyle has really helped some parts of my freeflying. I'm more relaxed on my head - I don't feel like I need my arms and legs in any one place to get there. It had also REALLY helped with sit coaching jumps. When you've got a floater or a corker, there's nothing better than going to your knees to get up there and keep them in frame. It keeps you upright and moveable, so getting out of the way is easier if they suddenly come toward you. I have also found that my freestyle speed is best for playing with belly fliers! If you're a small freeflier and want to have some fun with your belly friends, get out there and bust some freestyle moves right next to them. I have a great friend at Skydive Alanta, and we've gotten to the point where I can hit a heel stretch and hand her my foot. Or I'll be in Indian style and she'll come grab my knees and whirl me around. It's such a fun, relaxed skydive, because we're both usually docking on formations (me in a sit or on my head and her in her belly), and it's great to go out and screw around and laugh together. I'll try to post some screen grabs I have of my friend Angela (I think she normally jumps at Palatka), who is an amazing freestylist, especially considering her jump numbers. Mel Jerusalem is also a great person to grab if you see her at a boogie. Feel free to PM me if you want some advice, but I'm really just an amateur at it. I've seen Merriah Eakins (sp?) on video at nationals - pick that one up if you want to see something spectacular.
