  7. I'm not saying that at all. I'm saying it's proved or disproved essentially the same way that expert medical or egineering testimony is used in court to prove or disprove a medical malpractice or product liability case, combined with the same way that it's proved or disproved in court that, for example, a police officer has conducted an unlawful search and seizure. As this is based solely on implied intent I'd say this is different than all those above case examples you gave. As to individual challenges on a case-by-case basis, it will depend upon the particular circumstances and evidence of each case. From plenty of courtroom experience, I can tell you that, while not impossible, it's very, very hard to get a judge to reject, as a pretext, the seemingly-legal reason given by an officer as to why he initially stopped the suspect. It's generally easier to convince juries of citizens of this, depending upon the demographic makeup of the individual jury. As to challenges to future application of this law - such as that AZ police officer's lawsuit - if the case goes to trial (and I'd expect it would probably be a jury trial), there will be a "battle of experts" giving competing learned opinions as to past case studies, statistical analyses, criminology, psychology, human behavioral factors, etc. So you're saying it can't be proved/disproved. We agree on that.

It's breathtaking simple: if a law gives a "wink and a nod" to not using racial profiling, but as a practical matter it is not capable of being enforced without racial profiling, then the net (and legal) effect, nonetheless, is that it requires racial profiling. This may be above middle school civics, but it's really not that complicated an analysis. I don't understand what the opposition to this is. If they are pulled over or stopped for breaking another law, other than "suspected illegal immigrant", where is the profiling? Innocent victim of drive-by shooting - Being around people in violent gangs is just not smart. Innocent victim of a drunk driving incident - I'm gonna go with this one as there's usually little one can do to prevent this versus stay off roads at certain hours of night. Bystander in a war - sorta like being around a violent gang. Tragedies happen but most things happen due to people not heeding certain warning signs or by putting themselves in dangerous situations.   16. "racial profiling" is such a BS thing becuase race is only part of the critieria. If you know drug dealers and traffickers generally match a certain description and m.o. and they are observed breaking the law, it should not be illegal to stop them and if probable cause justifies, question and search. If someone matches a general description of an illegal immigrant and they are observed breaking the law, they should be able to be questioned. This doesn't mean one only concentrates on people that match that description but they should also not ignore their instincts. Profiling really can't be stopped. Even if they start tracking who gets stopped and questioned strictly by race and not by ratio of stops to arrests or it's very easy to "fix" those numbers by simply stopping a few people that purposely don't meet those requirements. Besides, in my experience, if they stop you for a something minor but are looking for something major (trespassing vs. robbery) (minor traffic violation vs. DUI) they'll usually just give you a verbal warning if you don't meet that criteria.

Agree that money isn't the only way to "earn" a house but the value of those tasks or others would need to be determined and factored in which would then create a legal contract that either dictates for doing "x" jobs y% of the house equity is awarded or for every time "x" job is done $y is contributed to the home equity. This creates a tracking hassle and/or a potential legal nightmare for both as claims of breach of contract... Just not worth all the hassle. This I don't agree with. Any attempt to logically proactively prepare for if things don't work out, means they aren't right for each other? It's basic disaster recovery/emergency procedures. If you plan for it and know you'll to do, both parties are better off. Chances are if you're ready for it, it's less likely to happen and if it does, it's less traumatic for both.
