I think that if a person or persons are found guilty of premeditated murder, then the next of kin of the victim (or a vote system if more than one victim of different family's are involved) should decide if it's to be the death penalty or life incarceration. However, the act makes it clear that an offence is only committed if someone is injured, interrupted or put in danger and that did not happen in this case.” Mr Barnard was awarded full costs and the judge ordered the police to return his guns.
