Logical fallacy (false dichotomy) - something does not have to be 100% effective to be worth doing. DUI laws don't stop all drunk driving, but they certainly reduce accidents. But how do you know this? How long has drinking and driving been illegal and what are the stats before and after? (I honestly don't know that it was ever "legal", but ALL guns were legal at one point) Drug laws don't stop drugs from being readily available, even the controlled substances via prescriptions. Hell, I work in the car business, I'd be willing to bet you a month's pay I can get my hands on almost any drug you could name inside an hour. Laws don't stop the determined criminal or the one that simply doesn't care of the consequences. They also don't stop the psychotically imbalanced (crazy) people.
