Rules ?? We don't need no stinking rules. But I'll play. We need to grow the economy. One drag on the economy is frivolous lawsuits. Pass "loser pays" legislation that says the loser in a lawsuit pays the other side's legal expenses. That way, a plaintiff with a good case wins and the defendant pays, but if the plaintiff loses, the defendant isn't stuck with a mountain of legal fees. One effect of this would be to reduce medical expenses for defensive testing by docs who want to reduce exposure to malpractice suits. e.g. "My kid didn't get into college, so the doctor who delivered him must have done something wrong." "No, no", says the doctor. "I gave that kid an SAT test in the delivery room and he scored the same as every other newborn. He was fine when you took him home." Build the Keystone XL pipeline. Create some jobs. Get oil from a place closer to home. Not using tar sands oil doesn't save the environment, because the Canadians will just sell the oil to China and the Chinese will burn it to power factories that make products for Wal-Mart. not replying to anybody in particular, just to the issue of a self-regulated industry - The BP Macondo well blew out and killed 11 people in a highly regulated industry. Skydiving's not doing all that bad. You don't have to outrun the bear. -

Sorry, but I think you missed his point. It's a great idea, but look how many times the analysis posted by the OP uses the word "rational". How are you going to apply "rational" to Congress? You don't have to outrun the bear. -
OK, short story: When I hike in the summer, I carry a stick about 5 or 6 feet long. A while back, I started out on a trail in a local state park. A guy saw me, looked at my stick and asked, "Why do you have such a long stick?". I replied, "In case I meet a long snake.". You should have seen the expression on his face. I guess he hadn't considered that possibility. You don't have to outrun the bear.

not replying to anybody in particular, but the hostage case in Alabama doesn't really apply here. The cops and FBI talked to the hostage-taker for several days and gave him a chance to surrender. That is enough of a safeguard of his rights to constitute "due process". Let me pose two hypotheticals for you guys to gnaw on: 1) The U.S. is invaded by uniformed, armed foreign troops who begin to destroy property and kill anybody who gets in their way. Can local law enforcement shoot them without waiting for a judge to rule? 2) A U.S. citizen is charged with a crime, but flees the country before a trial is held. If he knows he has the right to appear at a trial to confront witnesses against him, but declines the opportunity, can he be tried in absentia before a jury? If the jury convicts him, can he be sentenced? You don't have to outrun the bear.

Great answer. So what I was wondering; Does banning the transfer of an item between two private individuals within a state's borders stretch the interstate commerce clause too far, even tho that item may have come into the state from somewhere else? You don't have to outrun the bear.

I think paragraphs 36 (b) and 37 (b) exempt your squirrel gun and note that the "Chipmunk Single Shot" is completely exempted - a glaring loophole. Serious question: What does the phrase "in or affecting interstate or foreign commerce" mean in this bill? You don't have to outrun the bear.

Not you in particular, but where did you folks get the idea the Feds were ignoring handguns? They're just groping for something that presents a spector of evil to the public. A couple of decades ago it was cheap, easily concealable handguns. You don't have to outrun the bear.

As far as the washing in warm water goes, I have seen a case where a drink (Mountain Dew) was spilled on a leg strap. When that dried, the fabric became very slick and slipped badly. Washing in Woolite and warm water cured that problem. That doesn't seem to be the problem here. You don't have to outrun the bear.

Well, there was the bagged ice price-fixing case, the Dow Chemical polyurethane price-fixing case, the McKesson Medicaid case .... The Department of Justice prosecutes dozens of price-fixing cases every year. Whether that amounts to "regularly" or "rarely" is up to you. You don't have to outrun the bear.

You're pretty much on the mark. This is really more a case of "hey, I'm a legislator now. I need to legislate something !! " The honorable legislator in question here has been in office a couple of years. She's trying to make her mark on history, but the fact is, there are already laws against tampering with a witness or a victim, tampering with evidence, obstruction of justice, etc. This law is not necessary. You don't have to outrun the bear. -
DZ gets fined for "unairworthy" airplane

At the risk of adding fuel to the fire - which I sometimes do when I'm bored: It's not always that clear-cut. e.g. Local inspector visits local dz on a rainy day when the airplane is not in use. Inspector asks to see aircraft maintenance records. DZ mgr says they're in the airplane. Local inspector looks and finds no such records. He cites the DZ for violation. Later in the day, airplane owner returns from local Kinko's where he was making copies of records for safe-keeping. Now the process begins. It's hard to draw correct conclusions without knowing the relevant facts. You don't have to outrun the bear.
