I didn't, however, want to take the name of someone else's company if they've already established themselves in the sport. So, if there are no objections brought forward.... AIREAL VISIONZ is now requesting "TradeMark" status within the skydiving community/world. If you, or someone you know, have this as your name (or a variation)...let me know. I'll go back to the drawing board with one of my earlier conceptions. Thanks! quade 4 #2 August 19, 2003 First things first . . . know your intellectual property rights and what's what. Specifically, in this case, you're looking for a Trademark not a Copyright. Copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression. Copyright covers both published and unpublished works. (1) A trademark is a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others. (2) So identical names can be used by various companies as long as they are not in the same line of business as long as there is no confusion in the minds of consumers. Very large companies would argue differently and would put pressure on you to not use "their" name. For instance, I suggest you do not open up any business with the name "Disney" anywhere in it. Even if your family name actually is "Disney", you'd spend an awful lot of time in civil court if you decided to call your business "Disney Photography". Like a Copyright, you're protected the moment you decide to use your Trademark and no formal filing is required, but obviously a filing offers greater protection. If you go to http://www.netsol.com and click on who is in the top right corner, you can see if a URL is actually owned by anyone. For example, I checked www.aerialvisionz.com and it is available. Now, New Media Systems, that owns www.aerialvisions.com could get upset about your similar name, but I doubt that a large profile aerial (just from planes and aircraft, not skydiving) photography company will really care or ever find out about your tandem video company. go for it. peace lewhttp://www.exitshot.com Quote Share this post Link to post Share on other sites

I've got an accent over my E in my logo. I'm still playing with that one word, but I've decided on the two words for my name...and the last one stays as is. I'll look it up and google it as well - thanks for the suggestion. Actually thought of it last night, but have been so busy at work today. So, how's the leg?? I hope you heal up well and quick!
