TL;DR Just cause it's legal, an employer can still fire you if you fail a drug test.



this is the right balance, IMO

employer and employee should be able to enter into almost any employment agreement they both voluntarily sign

I'm on the fence while it is still illegal federally. Plus, this was a worker for a huge corporation. I can't name any of my friends who were drug tested for a job here in CO, myself included. Careers range from accounting, IT, health services, graphic design, personal trainer for a national chain, banking, etc. Most (most) employers don't give a shit, and acknowledge they would probably lose most their workforce if they started testing. My $0.02.

Certainly if a company wants to enforce a policy like that, they will need to take a look at the work force pool and decide if they are willing to pay extra for a 'clean' worker.

Or, on the other side of the opinion, if the policy might be a selling point for working there.

Or even decide if they want to enforce only for certain job descriptions.
