If they were publicly-available, there was no need to subpoena them, so the subpoena would be a form of official abuse of judicial process, and a pretext for unlawful governmental intimidation of clergy. 2. If they weren't publicly available, subpoenas to churches (mosques, synagogues, etc.) for private records are generally given very strict scrutiny, and courts generally only enforce them when, supported by a clear showing of probable cause, they're narrowly-tailored to lead to evidence of crimes (and/or actionable civil claims), such as sexual abuse, embezzlement, fraud, etc. 3. Courts are also, properly so, very loathe to scrutinize speech within churches, especially things such as sermons, for evidence of non- tax exempt purposes included in with all the tax-exempt purposes.
