Should you surrender to the police? (watch video)

The law was that you were req'd to show it to anyone if you had it on you. You were req'd to have it on you if you were operating a motor vehicle. If you did not have it on you & were not operating a motor vehicle, you did not have to show it ( you actually could not show it since you did not have it in your possession ).

One evening this guy was driving ( IMO ) rather nutzy, to the point that I actually thought he might not have a license. He pulled into a gas station and I pulled in also. I went over to him and demanded to see his Driver's License. He said something to the effect of, "Whaaat?' I informed him of the law and he showed me his Driver's License. I then left.

I make no assumptions about you or your knowledge of the laws of the State of Oregon, however it was the law in Oregon. And, as I mentioned previously, I do not know if it still the law in this state. You got any strange laws in the UK that you would determine "it still doesn't make sense?"

Ok, so how do they know? If someone says 'show me your dl' and you say you don't have it, how do they know? You might be complying, you might not be, who could say? Makes no sense.

Please entertain us and provide valid facts when a cop asked a person questions, where they were shot as a result of saying "no" to that cop. Please do tell....:S:S:S:S:S

Not at all, what gave you that idea? I just find it fascinating how people end up believing stuff that's so obviously untrue, and your supposed Oregon DL law blatantly never existed.

If you can show me that it did exist I'll quite happily admit that my bullshit detector is completely broken, but until then I'll continue to view your claim with amused bemusement.

This isn't directed specifically at Jakee. I'm just trying to help out with the question you guys are wrestling with: is it OK for a police officer to randomly stop an individual and ask for ID. That's a more complicated question that it seems at first glance. The U.S. Supreme Court, in Delaware v. Prouse, held that police officers may not randomly stop individual motorists to check for ID. However, roadside checkpoints are constitutional, as long as there is some public interest in the roadblock, i.e., sobriety checks, or seatbelt checks, and the roadblock is conducted in some sort of systematic manner. http://www.law.cornell.edu/supremecourt/text/440/648 The question of stopping pedestrians on the street is trickier. Some cities, like New York, have instituted "stop and frisk" policies where individuals are stopped for little or no reason, frisked, and questioned. This has been found unconstitutional by a federal court, but that decision is on appeal. http://ccrjustice.org/stopandfrisk.

Just wanted to give you gentlemen a little clarity on the subject of your argument. Carry on. :)
