normiss 905 #1 August 26, 2014 or just an irresponsible cop?
cgriff 0 #2 August 26, 2014 What crappy reporting... Whose murder is he being charged with? If it's the bystander gunned down by police, then yes, complete bullshit. Charge him with what he actually did, and it sounds like there's plenty; but the cop is the one on the line for that bystander's death.
normiss 905 #3 August 26, 2014 Everyone shot, was shot by the cop. Florida felony murder law is pretty widely applied when someone is killed during the commission of certain felonies. I understand the intent as "they wouldn't be dead if you had not committed the initial crime". It's just not always applied correctly IMO.
Southern_Man 0 #4 August 26, 2014 Yup, similar things have happened before... http://www.nytimes.com/2013/12/05/nyregion/unarmed-man-is-charged-with-wounding-bystanders-shot-by-police-near-times-square.html?_r=0"What if there were no hypothetical questions?" champu 1 #5 August 26, 2014 I have a very difficult time feeling sorry for the prime specimen this is landing on (concealed carrying an unloaded handgun with or without a permit and whether or not it's legal to do so where you are (e.g. A place that serves alcohol) makes you a clod) but in the process of making existing crimes "more illegal", felony murder laws also erode consequences for police failing to follow the "know your backstop / background" rule of handling and discharging firearms. It is unacceptable to me, and should be unacceptable to reasonable people, for the examination of the officers actions to end at "the suspect's actions justified deadly force" and for responsibility for anything that happened after that including his partner being injured and a bystander being killed to be transferred to the suspect. If YOU are an adult and YOU handle/shoot a gun, YOU hit what YOU hit. End of story.

normiss 905 #7 August 26, 2014 I didn't see any stories where he was actually carrying in the bar, only that he came back with a piece after being ejected. I also don't like the use of the felony murder law in those ways and it does seem to get used a lot that way. It would appear this cop did not take public safety into his process of dealing with this idiot in any way. Gotta agree with you.
